PAGE 1 OF 7 '-~J~~~~~ MOHAVE COUNTY BOARD OF SUPERVISORS "'-:...!~ ,RECORDING FEE 0.00 HC RESOLUTION NO. 91-229 A RESOLUTION SETTING FORTH APPROVAL OF A REVISED PRELIMINARY SUBDIVISION PLAN FOR RANCH ON JOY LANE, TRACT 4113, BEING A PORTION OF SECTION 31, TOWNSHIP 19 NORTH, RANGE 21 WEST, LOCATED IN THE SOUTH MORAVE VALLEY, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1991, a public hearing was conducted to determine the approval of the revised preliminary subdivision plan for Ranch on Joy Lane, Tract 4113, and WHEREAS, the developer for this project is Shapiro and Jones, of The engineering firm Inc. Phoenix, Arizona. responsible for the preparation of the design of this subdivision is A-N West, Inc. of Phoenix, Arizona, and WHEREAS, the project site is located approximately three (3) miles south of the Bullhead City limits and approximately two and one-half (2.5) miles east of Highway 95 on the southern boundary of Joy Lane, and WHEREAS, this two hundred sixty (260) acre site is being developed in six (6) separate phases. Access is provided to this subdivision from Highway 95, via Joy Lane, and Resoiution No. ~229 Page 2 ~JE 2 OF 7 ~ 1939 PG 976 (FEE~91-~7271) WHEREAS, this preliminary tract was previously approved by Board of Supervisors Resolution No. 90-304, and WHEREAS, this area of the South Mohave Valley is rapidly developing with a variety of subdivisions. More specifically, Copper Creek Ranch, Tract 4112, borders this development on the south and Palos Verdes Estates borders it on the eastern boundary, and by Sun and Fun, Tract 4124, on the northeastern border. This project is located on the western alluvial slope of the Black Mountains and is subject to flash flooding. However, a master drainage report, containing a detailed description of existing and developed drainage conditions' for the project has 1---' been submitted and reviewed for compliance with the Mohave County I I : Subdivision Regulations; however, a condition of approval for this tract is that all previous comments made by the County Engineer shall be resolved prior to Final, Plat action by the Board of Supervisors, and WHEREAS, the developer proposes to eliminate a forty-three (43) acre portion of Single Family Residential (SFR) use west of the EI Paso Natural Gas Line south of Clifton Road and north of Lipan Boulevard, otherwise labeled as Phase VI, and proposes to replace this SFR use with a forty-three ( 43) acre mobile home park, and r-'"\ '~ l'7':..:j 1':-;~-1 "-j J '--7 WHEREAS, the developer is currently negotiating with the i I I L Fort Mojave Tribal Utility Authority (FMTUA) and Sorenson for a sewage disposal trunk line. I~ Resolution No. Yl-22:1 . .page 3 .' 3 OF 7 1939 PG 977 (FEE~91-~7271) not have a problem with the proposed use, however, they would have a major problem with the proposed wastewater treatment plant. The Mohave Valley Irrigation & Drainage District (MVIDD) water allocation was approved for Phases II, III, IV, & V, but the revision of Phase IV, of which forty-three (43) acres which has a potential to be developed with a higher density land use, was not provided with a separate allocation, and WHEREAS, the water system includes an on-site well, a five hundred thousand (500,000) gallon storage tank and a booster station, and this development is within the Mohave Valley Irrigation and Drainage District, and WHEREAS, reviews have been received from the Mohave County Heal th Department, the Mohave County Public Works Department, Ci tizens Utili ties Rural Company, Bermuda Water Company, Fort Mohave Tribal Utilities Authority, Citizens Utilities Electric Company, and the Fort Mojave Mesa Fire Department, and considered or incorporated in the evaluation of this tract, and WHEREAS, the Commission at their meeting on August 14, 1991 did recommend CONDITIONAL APPROVAL of the revised preliminary subdivision plan for Tract 4113, with the following noted: 1. The northern thirty (30') feet of Antoinette Avenue shall be dedicated and improved from the western boundary of this tract to Ashley Street in accordance with standard specifications and Lipan Boulevard right- of-way shall be acquired through to the western paved boundary of Lipan Boulevard and east to Ashley Street (east to west through Section 31) for a full width of right-of-way dedication of eighty-four (84') feet and both shall be improved to Mohave County Standard Page 4 .~E 4 OF 7 K 1939 PG 978 (FEE~91-~7271) Specification #lOl.lOA, and reflected in the cost estimate and assurance for this subdivision. Resoluwn No. 91-229 2. Compliance with Board of Supervisors Resolution 90-304 shall be requiced. 3. The developer shall submit written approval from the Mohave Valley Irrigation and Drainage District stating that this development will have sufficient water allocation and supply. 4. That each lot shall be connected to an existing and functioning sewage facility. 5. Arrangements shall be made to extend underground electric and telephone service to each lot in accordance with Arizona Corporation Commission Regulations. 6 . Questions involving drainage shall be addressed and resolved to the County Engineer's satisfaction prior to submission of this subdivision to the Board of Supervisors for Final Plat action. Should there be a substantial redesign of the Revised Preliminary Plan as presented, due to changes in the drainage plan, the owner/subdivider shall be required to resubmit this subdivision ilE' a revised preliminary plan for review and consideration. I ' ! 7. The detailed drainage report shall include capacities for all roadways and channels intended for drainage control with accompanying computations. 8. Fire hydrants shall be provided at locations prescribed by the Fort Mojave Mesa Fire Department; street name and regulatory signs shall be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as recommended by the design engineer and approved by the County Engineer, the owner/Subdivider is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations. 15. Petitions of Exception were submitted and approved by the Board, Resolution No. 90-304, for the following deviations from the requirements of the Subdivision Regulations, as follows: a. Sewage disposal will be to a regional disposal facility. Reference to Parcel ~K~ and Parcel ~L~ shall be removed. The new preliminary plan shall reflect this correction. --- 22. Reference to Special Development Zoning descriptions shall be removed. The new preliminary plan shall reflect this correction. 23. Phase V and VI as depicted on the Revised Preliminary Plan shall be labeled with a parcel designation. 24. The detention basin depicted on the Revised Preliminary Plan shall be labeled with a parcel designation. 25. Lipan Boulevard shall be improved and acquired as stated in Item #2. The improvements shall occur when Phase VI, as depicted on the Revised Preliminary Plan, is developed. 26. Mobile Home Park Plans shall be submitted for both Phase V and V:::. These plans shall comply with Section 27.1 of the Mohave County Zoning Regulations. 27. Modified Special Development Plans shall be submitted for both Phase V and VI. 28. That the new preliminary plan shall include the details of the approved preliminary plan of Palos Verdes, Tract 4131, along the eastern boundary between Gazelle Drain and Joy Lane. 29. The first phase of development of this tract shall construct Joy Lane to the west section line, Marie Avenue to point of contact. Water system of such capacity as to provide total tract and sewage disposal mains to serve the entire tract. 30. The following standard conditions are noted that apply to all submittals at this stage: a. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tr~ct by the Boa~d and a final copy shall be submitted to Commission staff for record keeping. b. Arizona Department of Health Services approves the water supply and distribution system. d. The public utility easements shall be depicted on or across all lots. e. The ownership of the land shall be shown on the face of the New Preliminary map and other documentation. f. A corporate entity, to include the total subdivision, Tract 4113, shall be formed/allow for provisions of perpetual maintenance for this project's block walls, drainage easements, or any other facilities deemed private in nature, as detailed in the CC&R's. The recorded articles of incorporation, forming the property owner's association shall be submitted with Final Plat.
