PAGE 1 OF ' 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-223 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ALLOW THE ESTABLISHMENT OF AN ON-SITE DIESEL FUELING SYSTEM IN AN A-D (AIRPORT DEVELOPMENT) ZONE ON PARCEL VI-E-A RECORD OF SURVEY, IN THE SW~ SECTION 23, TOWNSHIP 22 NORTH, RANGE 16 WEST, LOCATED AT THE KINGMAN AIRPORT INDUSTRIAL PARK, MORAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held August 19, 1991 a public hearing was conducted to determine whether approval should be granted to Industrial Planners Group, Inc. of Chicago, Illinois, for a [. zoning Use Permit to allow the establishment of an on-site diesel fueling system in an A-D (Airport Development) zone on Parcel VI- E-A Record of Survey, in the SW~ Section 23, Township 22 North, Range, located at the Kingman Airport Industrial Park, and WHEREAS, Section 23 is located approximately 5.5 miles north of the I-40 and Andy Devine Avenue junction and includes a portion of the Kingman City Airport. This parcel can be accessed from Highway 66 via Industrial Parkway, east to Industrial Boulevard, thence north to Mohave Airport Drive. The property is immediately north of the intersection of Industrial Boulevard and Mohave Airport Drive. Surrounding uses consist of vacant land t(i:1 and commercial/manufacturing uses, and _..J '- -" Resolution No. 9~3 . Page 2 WHEREAS, current requirements wi thin ~ PAGE 2 OF 3 BK 1933 PG 991 (FEEt91-4472&) Section 13.1 of the Mohave County Zoning Regulations states the storage of bulk fuels and flammable gases may be permitted within an A-D zone upon the approval and issuance of a Zoning Use Permit. This parcel is currently the site for a Cotter & Company (True Value) Distribution Center. The proposed diesel tank will be exclusively for the fueling of Cotter & Company vehicles. The applicant is installing an above ground tank in place of an underground tanks because of environmental concerns regarding groundwater protection. The Commission staff has received verbal approval from the Airport Authority and the local fire agency has given tentative approval for the preliminaries of the diesel installation. In addition, the applicant is currently acquiring approval for this system from ADEQ, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991 and did generate a recommendation of approval of the requested Zoning Use Permit contingent upon the following conditions: 1. That Zoning/Building permit(s) be obtained. 2. Erection of a buffer/protective wall meeting current regulations and code specifications. 3. Approval of appropriate fire agencies of plans for installation and operation of the storage tank. 4. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. This zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. -'l." )." ~ . . Resolution No. 91-223 Page 3 PAGE 3 OF 3 BK 1933 PG 992 (FEEt91-44726) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 4, 1991, and posted August 1, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, August 19, 1991 approved this zoning Use Permit as recommended by the Mohave County Planning and zoning Commission, subject to the conditions outlined herein.
