PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 91-219 A RESOLUTION SETTING FORTH THE REZONING OF W~ PARCEL 76, SECTIONS 17 AND 20, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/9A (AGRICULTURAL RESIDENTIAL/NINE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5, 1991, a public hearing was conducted to determine whether approval should be granted to James L. and Mary Ellen Teeter of San Diego, California for rezoning of the W~ Parcel 76, Sections 17 and 20, Township 23 North, Range 16 West, from A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) to A-R/9A (Agricultural Residential/Nine Acre Minimum Lot Size) zone, occupying the corner of Avenida Burro and Calle Muerlos in the Kingman area, and WHEREAS, Sections 17 and 20 are approximately two (2) miles east of Stockton Hill Road and approximately six (6) miles north of the Kingman city limits, and WHEREAS, review of floodplain map #040058-2000B indicates this area to be clear of flooding potential. The subject property is surrounded primarily by vacant properties, and ~~, ' .. ~ . Resolution No. 91.9 pt Page 2 2 OF 3 BK 1928 PG 177 (FEE~91-~2142) WHEREAS, the owner is applying for a zone change on a twenty (20) acre parcel of land, from A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/6A (Agricultural Residential/Six Acre Minimum Lot Size) zone, which permits the division of land into three (3) parcels of approximately 6.33 acres each after deducting easements, and WHEREAS, the applicant has requested this zoning application be modified from A-R/6A (Agricultural Residential/Six Acre Minimum Lot Size) to A-R/9A (Agricultural Residential/Nine Acre Minimum Lot Size), and [:; Plann:~::' Z::in:heco:::::onheo:i;:lY b::~re19 ::~ t7eha::mm:::::: recommended APPROVAL of the modified zone change contingent upon the following conditions: 1. These parcels be zoned A-R/9A (Agricultural- Residential/Nine Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. These parcels shall meet or exceed nine (9) acre exclusive of road easements. 6. The Parcel plat shall show any surface drainage and FEMA designated flood zones. ~I] "...'-,-' ..--.... 7 . No. 91-219 " Page 3 intersection of Avenida Burro and Calle Muerlos. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. No building/zoning permits shall be issued until after Parcel Plat recordation. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being September 4, 1991, as per ARS 11-829E. 10. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the.notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 21, 1991, and posted July 18, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 5, 1991 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
