PAGE 1 OF '" MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-216 A RESOLUTION SETTING FORTH THE REZONING OF NW~ PARCEL 109, RECORD OF SURVEY, SECTION 13, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A- R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/5A (AGRICULTURAL RESIDENTIAL/Five ACRE MINIMUM LOT SIZE), A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE), AND A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA . WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5, 1991, a public hearing was conducted to determine whether approval should be granted to Jack A. and Bertha L. Anderson of Kingman, Arizona for rezoning of the NW~ Parcel 109 Record of Survey of Section 13, Township 21 North, Range 18 West, from A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) to A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size), A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size), and A-R/1A (Agricultural Residential/One Acre Minimum Lot Size) zones, occupying the southeast corner of Shipp Drive and Bowie Drive in the Golden Valley area, and WHEREAS, Section 13 is approximately .5 miles south of Highway 68 and approximately one (1) mile west of the interchange of U. S. Highway 93 and Arizona State Highway 68. The subject property fronts the south side of Shipp Drive and the east side of the Bowie Road extension, and , . Resolution No. 91-. . Page 2 PA 2 OF '" BK 1928 PG 169 (FEE~91-"'2139) WHEREAS, review of Floodplain Map #040058-2325B indicates this area to be clear of a designated flood zone. Adjacent land consists primarily of residential and vacant uses, and WHEREAS, the owner is applying for a zone change on an approximately 10 acre parcel of land, from A-R/10A (Agricultural A-R/1A Residential/Ten Acre Minimum Size) to Lot zone (Agricultural Residential/One Acre Minimum Lot Size) zone. This zoning will permit the subject property to be split into one acre parcels. The applicant proposes to split this parcel into a one acre parcel, a two acre parcel, and a five acre parcel, after deducting ingress/egress and utility easements. This property is located within the Valley Pioneer Water Company District and the Building Code area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 10, 1991, the Commission recommended APPROVAL of the modified zone change contingent upon the following conditions: 2. 3. 4 . ( ',", i j I lJ 5. 1. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. Each parcel shall have legal access. The zoning for the northwest quarter of this property be approved for A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size) zoning. The zoning for the north half of the southwest quarter of this property be approved for A-R/1A (Agricultural- Residential/One Acre Minimum Lot Size) zoning. .. Resolution NlIt91-216 . Page 3 p .~ 3 OF 4 BK 1928 PG 170 (FEE~91-~2139) 6. The zoning for the remainder of this property be approved for A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) zoning. ' 7. The Parcel Plat shall show any surface drainage and FEMA designated flood zones. 8. That the Board of Supervisors accept the dedication of a thirty (30') foot right-of-way as it is contiguous to the eastern and western property line of this parcel, which is the west half of Bryce Road and east half of Bowie Road respectively. In addition, a twenty (20') foot radius at the intersections of Shipp Drive with Bryce and Bowie Roads. These dedications shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and' dedication be shown on the Parcel Plat. 9. No building/zoning permits shall be issued until after Parcel Plat recordation. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being September 4, 1991, as per ARS 11-829E. 11. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the-notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 21, 1991, and posted July 18, 1991 as required by Arizona Revised Statutes, and the Mohave Ii County Zoning Regulations. ~ ,~,~ ~ ~-~...-.--, ....~~ . ...
