PAGE 1 OF 10 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC J RESOLUTION NO. 91-212 ;' t./ " , t <:.' , " (i ; J A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION OF HORIZON ESTATES, TRACT .3030-A, BEING A CONDOMINIUM SUBDIVISION OF PARCEL 3, ROADWAY & UTILITY EASEMENT PLAT OF SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, G&SRB&M, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5, 1991, a public hearing was conducted to determine the approval of the final subdivision plan, for Horizon Estates, Tract 3030-A located in the Golden Valley area, and WHEREAS, the owner/subdivider of this tract is D & S Investments, Inc. of Bullhead City, Arizona. The engineer of record on this project is Robert Schuetz, Mohave Engineering Inc., 405 E. Beale Street, Kingman, Arizona 86401, and WHEREAS, this proposed subdivision is located approximately 7.5 miles west of the junction of Highways 68 & 93 and fronts upon Highways 68's northern border. Moreover, this property is located at the northeast corner of Highway 68 and Hoover Road. This proposed subdivision is located on approximately forty (40) I :j 1.1 1.._...) acres of land, currently zoned A-R/ lOA (Agricultural Residential/Ten Acre Minimum Lot Size). This property is .' Page 2 PAGE 2 OF 10 BK 1930 PG 944 (FEE~91-43359) bordered on the north by Chino Drive and Golden Sage Ranchos #51, and on the east and west by forty (40) acre parcels that share common adjoining roadway easements, and WHEREAS, The approved preliminary subdivision plan depicts 258 condominium dwelling units, a 75,000 square foot commercial center, an apartment complex and a wastewater treatment facility including an infiltration ponding area. In addition, one parcel in the center of the tract will be utilized as a park area while two other parcels will be used as swimming pool and recreation areas, and WHEREAS, Tract 3030-A (a first Phase development) depicts eight (8) parcels of various uses including: the sewage treatment plant, infiltration ponds, commercial and multifamily parcels, boat and R-V storage area, private streets, recreational and common areas and condominium units. Parcel "G" and "H" are proposed to contain eighteen (18) dwelling units each, and WHEREAS, water service is being proposed through the Golden Valley Improvement District I and a sewage outlet connected to each dwelling unit and transported by gravity by a lift station to the wastewater treatment facility located on the project site, and WHEREAS, the road pattern is integrated with all existing and potential roads in the area. The interior roads and parking areas will be paved as well as Hoover Road from Highway 68 to . . Resolution No. 91~ ~ Page 3 PAGE 3 OF 10 BK 1930 PG 945 (FEE~91-43359) Chino Drive and Chino Drive from Hoover to Stewart Mountain Road and Supai Drive, between Hoover and Stewart Mountain Roads. Moreover, that portion of Stewart Mountain Road from Supai Drive south to the access point of Parcel "C" will be paved, and WHEREAS, the approval of this subdivision is based on the understanding that the perimeter roadways which serve as access to this subdivision are to be improved and paved with asphaltic concrete; the interior roads which are intended as private streets will also be paved with asphaltic concrete to minimum County standards or better; Golden Valley Improvement District #1 is to supply water to this tract and the owner/subdivider shall install a water distribution system to serve each parcel and unit within the subdivision; fire hydrants shall be provided in accordance with the requirements of the Mohave County Subdivision Regulations; sewage disposal is to be handled by a sewage treatment facility to be located on Parcel "B"; grading and drainage related improvements will be made as recommended by the project engineer in the drainage report to standards and as approved by Mohave County Engineering; arrangements will be made to extend underground electric and telephone service to each parcel or unit in accordance with Arizona Corporation Commission Regulations; all street centerline monuments will be staked and monumented in accordance with Mohave County Standard i '''1 Specification No. 102; street name and regulation signs will be I' "c' .... '.~' .. ~ installed in accordance with Mohave County Subdivision Regulations; a wall and/or decorative barrier shall be constructed around the perimeter of the residential lot Resolution No. 9141t2 4It PAGE BK Page 4 subdivision and as a condition of approval the 4 OF 10 1930 PG 946 (FEEt91-43359) owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board approves the said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the Subdivision Questionnaire to the Real Estate Commission as required for approval of this tract by the Board. A copy of the draft and final report delivered to the Arizona State Real Estate Department shall be submitted to the county; 2 . Arizona Department of the water and sewer subdivision; Environmental Quality approves system installation for this 3. The water system will provide adequate flows for fire protection. F ire hydrants conforming to the minimum county standards shall be provided and positioned in acceptable locations to the Golden Valley Fire Department; 4. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report as approved by staff, these improvements shall include all applicable comments within staffs letter dated July 16, 1991; (Exhibit "A" attached) 5. The owner shall obtain the matching right-of-way for Hoover Road, Stewart Mountain Road and Chino Drive and provide it to the Board in an acceptable format prior to recording the final plat for Tract 3030-A; 6. The Final Plat for tract 3030-A including the dedication shall be properly executed and/or sanctioned by all parties having any recorded title interest in the land being subdivided and included on this subdivision; ,.:....) 7. Concurrence from the Arizona Department of Transportation shall be obtained and submitted to the Mohave County Planning and Zoning Department for the proposed method of access onto and drainage along and/or through Highway 68; Resolution N~I-212 . Page 5 PAGE S OF 10 BK 1930 PG 947 (FEE~91-43359) 8. The cost estimate, in addition to the assurance, shall be revised to reflect staffs comments as set forth by their letter dated July 16, 1991; 9. The Improvement plans for Horizon Estates Tract 3030-A shall be revised to reflect the technical comments in staffs letter of July 16, 1991; 10. A petition of exception shall be submitted and approved by the Board of Supervisors, as specified in the Mohave County Standard Details and Specifications, for inverted crown streets -before recordation of this final; 11. A property owner's association that is non-revocable shall be established by the followin<1J, at the same time the recorded: compulsory and recordation of final plat is A. Articles of Incorporation of the Association; B. Declaration of Restrictions; Covenants, Conditions and C. Bylaws of the association, to include provisions for maintenance of common open space; streets, recreation facility, walls and all other facilities held in common. 12. Conformance with all applicable provisions of Article VIII, Mohave County Subdivision Ordinance, and Chapter 9, Sections 33-1201 through 33-1270 Arizona Revised Statutes and State Real Estate requirements; 13. The commitment to lend from Stockman's Bank expires at 6:00 P.M., on August 6, 1991. Proof of extension shall be submitted to the Mohave County Planning and Zoning Department; 14. Rezoning resolution 91-76 shall be complied with properly as it relates to Tract3030-A. The plan as submitted appears to address the items from the Preliminary Plan review and approval and/or meets the requirements of the Mohave County Subdivision Regulations, however, the following is a list of items/comments which need to be submitted/addressed before this office can continue processing of Tract 3030-A: FROM THE MORAVE COUNTY PUBLIC WORKS DEPARTMENT: 1) The private roadways shown on the Final Plat are labelled as private roadways and public utility easements. The drainage addendum dated January 1991, shows flows being carried within these streets. If these streets are to be used to carry flows they will also need to be labelled as drainage easements. 2) If it is the intent to use onsite areas for floodwater retention, .these areas will need to be shown and labelled as drainage easements on the Final Plat, to be granted to the public for their intended purpose. The purpose of this is to insure the future integrity of these areas. --.- 3) The proposed design of the retention areas to include inlet and outlet structures , capacity, calculations, depth of floodwater, _ methods of erosion protection, etc., needs to be submitted to this office in the form of a revised Drainage Report and revised improvement plans for the County Engineer'S approval. 4) Concurrence from the Arizona Department of Transportation needs to be obtained and submitted to this Dept. for the proposed method of access onto and drainage along and/or through HWY 68. ! ~~'":' ~-_""~-"'~'7'~~4:"":-:.-:-_"~"'~'-".""_~.:o""-;-~.:'"'S~.~~_.'~r",:.._.:--~--.......--._~. - ..~....:-,..:. ........-;"T..,....:...._...-..-.r.:':""~':',-;,7~~':":'~.~~_. .. July 16, 1991 PAGE 8 OF 10 BK 1930 PG 950 (FEE~91-43359) MOHAVE COUNTY PUBLIC WORKS COMMENTS CONTINUED: 5) The Final Plat needs to show street centerlines and street centerline monumentation at all intersections and changes in direction. (Article 4.8-1) Mohave County Standard Specification No. 102 requires that surface and subsurface monuments also be set for street centerline monumentation. Normally monuments would be required at the intersections of Hoover Road and Stewart Mountain Road with Hwy. 68, however because of the traffic hazard, this Department would recommend these monuments be set on the North R/W line of Hwy 68 as witness monuments. 6) This Department recommends that the developer be required to construct Stewart Mountain Road in its entirety along the subdivision boundary to promote future traffic circulation around this subdivision. 7) The improvement plans need to show water hookups to lots along Martin Way. 8) Mohave County Standard Details and Specifications require inverted local streets to have a minimum of 40' pavement width. The improvement plans currently show inverted local streets as having only 32' width including curb and gutter. If, less than minimum standard street widths are proposed,: then a petition of exception will be necessary granting their approval. A petition of exception is also, required for inverted crown streets. 9) The Assurance letter'dated April 25, 1991, from D & S Investments, Inc. does not meet the requirements for an Assurance as set forth in Article 5.0 of the Mohave County Subdivision Regulations." We recommend the developer review the aforementioned Article prior to submittal of a revised Assurance. 10) Since the south 8' of Chino Drive has been abandoned by BOS Res. 91-77, the following changes to the final plat need to be made: A. The label "Future right of way line" should be revised to "New right of way line" since it is now the south R/W line. The label "Existing should be revised easement line". 50' to wide road easement "Previous 50' wide line" road C. The previous R/W line should be. a dashed line, since this was an easement. D. The note about Res. 91-77 should be revised as follows: "South 81 of Chino Drive was abandoned by the Mohave County Board of Supervisors Resolution No. 91-77" . E. The detail of this area also heeds to be revised similarly. 11) The Dedication statement appears to dedicate all streets to the public. If the statement is revised as follows, it should rectify this situation: .. . . . companies and dedicate the public streets to the public...". FROM THE MORAVE COUNTY PLANNING AND ZONING DEPARTMENT: 1) Contiguous rights-of-way for Hoover Road, Stewart Mountain Road and Chino Drive will be acquired or be shown as existing or permanently reserved for future road purposes. The dedication statement shall contain the dedication of all perimeter streets including the one hundred (100) foot Highway 68 strip and corner radii. 2) Included in the Declaration of Covenants, Conditions and Restrictions (C.C.& R. 's) shall be provisions for Sections a.10A, D & F, of the Mohave County Subdivision Regulations. The C.C.& R. 's should also reference each parcel as designated alphabetically and by the intended use. 3) Clarify the parcel names in the dedication statement and add a title to the survey and staking statement. -..-.-....-- .-.-. -.- . ._--------~ -..-.---..------...... ,,,-,,._~'- . . .BIT "A" RESOLUTION 91-2. Arrows depicting the direction of drainage flows. B. The dimensions of'eac~ lot/single story duplex. c. Parcel G and H are described as "Residential Lot/Duplex units and Common Areas" . Staff recommends that each unit within parcels G and H be better defined. Furthermore, Parcels G and H shall be labelled as Access Easements. D. Indicate stubs for future road extensions. E. In the Granting of Easements statement, identify properties, including those south of Highway 68. 5) The commitment to lend from Stockman's Bank expires at 6: 00 pm, on August 6, 1991. Proof of extension shall be submitted to' this office. 6) Improvement details for Parcel Band D shall be provided to this office. Upon receipt of all the aforementioned materials, signed and certified, along with corrections on the "Final Plat, we will proceed with finalization on this project.
