PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-208 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A SWAP MEET IN AN R-E (RESIDENTIAL RECREATION) ZONE LOCATED IN LOVIN'S SUBDIVISION, BLOCK 1, LOTS B AND A PORTION OF LOT C, LOCATED IN OATMAN, IN THE MOHAVE GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held August 5, 1991 a public hearing was conducted to determine whether approval should be granted to Jim and Janet Bokan of Oatman, Arizona for a Zoning Use Permit to establish a swap meet in a R-E (Residential Recreation) zone located in Lovin's Subdivision, Block I, Lot B and a portion of Lot C, located in Oatman in the Mohave General area, and WHEREAS, Oatman is located in the Black Mountains on Highway 66 between Kingman and the South Mohave valley. The current zoning for this site is R-E however, there are a number of nonconforming commercial uses that have been in operation before 1968 prior to County zoning regulations. The applicants are the owners of the establishment known as the "Mission Inn". The applicants desire to establish a swap meet in the rear of their property behind the currently operating restaurant. As previously mentioned the zoning is R-E but has operated as commercial for some time, and ,.1' i -1 i I I I , ! 1 , I I I , j I I I j I I l_~ J1I Resolution No. 91~8 pi 20F BK 1928 PG 3 139 (FEEt91-~2131) Page 2 WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on July 10, 1991 and did generate a recommendation of approval of the requested Zoning Use Permit contingent upon the following conditions: 1. The resolution note that the approval of a zoning use permit in a R-E zone is based on the unique situation of the nonconforming commercial nature of this lot. 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 3. The applicant shall submit evidence that access to the property is legal and properly dedicated. 4. The public meeting area shall be covered with a dust- proof surface. If crushed rock is used for the dust- proof surface then the soil shall be maintained in a weed free condition. 5. That pertinent building/zoning permits be obtained. 6. The applicant shall ensure adequate fire separation is maintained. 7 . There shall be no overnight parking of R-V's, trailers or camping. 8. That sanitary facilities be provided Department of Environmental Quality Health Department requirements. as per Arizona and/or County 9. Operation of the swap meet shall be limited to the hours of 8:30 a.m. to 9:00 p.m. on Friday, Saturday and Sundays or a reasonable schedule per request of the applicant. Amended times may be approved in writing by the P&ZC Staff Director if kept within spirit of approval. 10. The site shall be cleared of all Storage containers, merchandise and tables within two (2) hours of Sunday closure as posted by the owner. 11. The applicant shall meet all requirements of the State Department of Revenue in regards to the sale of goods. 12. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. ...r , '.. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 14. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on July 21, 1991, and posted July 18, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 5, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
