RESOLUTION NO. 91-207
A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR
USE OF A LEASED SECTION OF BLM LAND FOR COMMERCIAL RECREATIONAL
PURPOSES IN SECTION 22, TOWNSHIP 21 NORTH, RANGE 20 WEST, LOCATED
IN THE MOHAVE COUNTY GENERAL/NORTH MOHAVE VALLEY AREA, MOHAVE
COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held August 5, 1991 a public hearing was conducted
to determine whether approval should be granted to Cris Gammell
of Kingman, Arizona for a zoning Use Permit to allow organized
back country horse rides in Section 22, Township 21 North, Range
20 West in the Black Mountains west of Union Pass on Highway 68,
Mohave County General/North Mohave Valley area, and
WHEREAS, Section 22 is located approximately 16 miles west
of the interchange of u.S. Highway 93 and Arizona State Highway
68 and 7.5 miles east of the Highway 68 and 95 junction. The
subject property fronts the south side of Highway 68 on the west
slope of the Black Mountain range, and
WHEREAS, review of Floodplain Map #040058-2325B indicates
this area to be clear of a designated. Adjacent land consists of
vacant land.
The applicant is leasing BLM land for the purpose
of establishing riding stables, and

WHEREAS, a public hearing before the Mohave County Planning
and zoning Commission on July 10, 1991 and did generate a
recommendation of approval of the requested Zoning Use Permit
(ZUP) contingent upon the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. In addition to compliance with Ordinance
87-1 (Dark Sky Ordinance).
2. The applicant. acknowledges that ADOT is reserving "the
right of review for any changes in use or increase in
Average Daily Traffic generated from this section."
The applicant shall comply with ADOT requirements.

3. The maximum number of horses shall not exceed ten (10).
Any increase over this number will invalidate this
permit or subject it to review and modification through
additional hearings by the Commission.
4. That appropriate zoning/building permits be obtained.
5. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
6. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
7 . I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on July 21, 1991, and posted July 18, 1991
as required by the Arizona Revised Statutes and the Mohave County
Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, August 5, 1991 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.

Dear Mike,
Regarding the recent request to rezone a portion of
Sec.22,T21N,R20W, abutting SR68 at aprox. MP 10+-. ADOT
would have no objection to the rezoning. ADOT would however
reserve the right of review for any changes in use or
increase in Average Daily Traffic generated from this
section.
Once again I would like to thank you and the rest of
the County staff for including ADOT in the review process.
