RESOLUTION NO. 91-299
A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO
ESTABLISH A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE ON LOT
3, BLOCK 4, NEW KINGMAN ADDITION #1, LOCATED IN THE KINGMAN AREA,
MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held November 4, 1991 a public hearing was
conducted to determine whether approval should be granted to
Oliver and Janette Nye of Minneapolis, Minnesota for a Zoning Use
Permit (ZUP) to establish a residence in a C-2
(General
Commercial) zone on Lot 3, Block 4, New Kingman Addition #1,
located on the east side of Mallard Drive, one hundred (100')
feet south of Diagonal Way in the Kingman area, and
WHEREAS, New Kingman Addition #1 is located approximately
two (2) miles northeast of the eastern I-40 and Highway 66
intersection.
The subject property is accessed from Highway 66
this area to be clear of a designated floodplain.
The site is
via Diagonal Way west approximately three hundred fifty (350')
feet to Mallard Drive thence south approximately one hundred
(100') feet on the east side of the street, and
WHEREAS, review of floodplain map #040058-2165C indicates
currently vacant.

and some vacant land.
The commercially zoned property to the
north and south side are occupied with homes.

WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on October 9, 1991 and did generate a
recommendation of APPROVAL of the requested Zoning Use Permit
contingent upon the following conditions:
1. That appropriate zoning/building/environmental permits
be obtained.
2. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
3. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and

after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County,
Arizona on October 20, 1991, and posted October
18, 1991 as required by the Arizona Revised Statutes and the
Mohave County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, November 4, 1991 approved
this Zoning Use Permit as reconmended by the Mohave County
Planning and Zoning Commission,
