RESOLUTION NO. 91-293 A RESOLUTION SETTING FORTH THE REZONING OF THE E~ NE~ PARCEL 36, SECTION 9, TOWNSHIP 21 NORTH, RANGE 18 WES'I', FROM: A-R/5A (AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) AND A-R/IA (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN 'I'HE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1991, a public hearing was conducted to determine whether approval should be granted to Tina Paul of Moorpark, California for a zone change from existing A- R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone to A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) and A-R/IA (Agricultural Residential/One Acre Minimum Lot Size) in the E~ NE~ Parcel 36, Section 9, Township 21 North, Range 18 West, occupying the southwest corner of Brook Drive and Magma Road in the Golden valley area, and WHEREAS, Section 9 is located approximately four and one- half (4.5) miles west of the junction of Highways 68 and 93 and is bisected by Highway 68. Section 9 is bounded by Chino Drive, Aztec Road, Shipp Drive and Verde Road. The subject property is accessed from Highway 68 via Verde Road south approximately 1350 feet to Brook Drive thence east approximately 1320 feet to the , ...... .. '. Resolution No. 914113 . Page 2 southwest corner of Brook Drive and Magma Road, and WHEREAS, review of floodplain map PAGE '2 OF BK 1968 PG #04005S-2325B 3 170 (FEE~91-60015) indicates this area to be clear of a designated floodplain. The five (5+) plus acre site is currently vacant. Surrounding land uses consist of mostly vacant land and some residences. Parcel 36 and Parcel 35 to the north have a number of one acre parcels. The applicant desires to split this site into one 2+ and two 1+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Co~nission on October 9, 1991, the Commission recommended APPROVAL of the reques ted rezoning contingent upon the following conditions: 1. The two southern parcels be zoned A-R/IA (Agricultural- Residential/One Acre Minimum Lot Size) and the northern parcel be zoned A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two southern parcels shall meet or exceed one (1) acre and the northern parcel meet or exceed two ( 2 ) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. The Board of Supervisors accept the dedication of a thirty (30') foot right-of-way and eight (S') foot PUE along the north and east boundaries of this parcel. In addition, a thirty (30') foot roadway easement and eight (S') foot PUE along the south boundary of this parcel. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. PAGE 3 OF 3 BK 1968 PG 171 (FEE~91-60015) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on October 20, 1991, and posted October 18, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1991 approved this change in zoning as recomnlended by the Mohave County Commission and outlined herein.
