PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 91-291 A RESOLUTION DENYING AN AMENDMENT TO THE ADOPTED SOUTH MOHA VE VALLEY AREA PLAN TO PROVIDE FOR COMMERCIAL AND MULTIPLE FAMILY RESIDENTIAL USES IN A PORTION OF SECTION 15, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1991, a public hearing was conducted to deny an amendment to the adopted South Mohave Valley Area Plan to provide for commercial and multiple family residential uses in a portion of Section 15, Township 19 North, Range 22 West, being north of Camp Mohave Road and east of Highway 95, and WHEREAS, the Planning and Zoning Commission is required to recommend to the Board of Supervisors a County land use General Plan which is designed to conserve natural resources, to insure efficient expenditure of public funds, and promote the health, safety, convenience, and general welfare of the public, and WHEREAS, Section 15 is located immediately south of Bullhead City's southernmost boundary. Section 15 is bounded by Sterling Road, Arcadia Lane/Highway 95, Camp Mohave Road and Fort Mojave Indian Reservation land. The section was subdivided as Le Clair '-"-' ... . The eastern portion of the section has a mixture of R-M (Multiple Family Residential), C-2H (Highway Commercial), C-M (Commercial Manufacturing) and C-MO (Commercial Manufacturing/Open Lot Storage) zoning. The R-M zoning occupies the E"2 S~ of the section. The commerc ial zones are on the eastern perimeter of the section. The western portion of the section, except for 5 acre C-2 (General Commercial) property, is residential and zoned A-R (Agricultural Residential), The current area plan indicates the western portion of the section is designated A-R, and WHEREAS, the request before the Commission was for a commercial designation at the corner of Gardner Road and Calvary Road. The site is a ten (10) acre lot and the applicant desires to establish a commercial use on the southeastern four (4) acres of the lot, and WHEREAS, the Commission Staff held a public meeting for input on the requested amendment. The meeting was held on October 2, 1991 at the Joy Lane Elementary School. Thirty (30) persons were in attendance in addition to the applicant and staff. The attitude of the attendants was that any further incursion of commercial uses in the west half of the section would be undesirable, and WHEREAS, the Planning and Zoning Commission at their meeting on October 9, 1991 did recommend DENIAL of the proposal to amend ..,. Resolution No. 91-~ . Page 3 ..... the South Mohave Valley Area Plan based on the following: 1. The character of .the area west of Calvary Road is residential in nature. 2. There exists a large amount of commercially zoned and designated acreage that is vacant in the South Mohave Valley area. 3. Of the 30 persons in attendance at the 10/2/91 public input meeting for the area plan amendment, ALL were in opposition to further commercial expansion in this section. 4. The property owners at the meeting indicated they wish to retain their A-R designation and the existing low density residential character. 5. Disposition of water service in the area needs to be addressed before allowing further development. 6. The current proposal for development of the parcel which initiated this request would need a C-2H zone. The location of the request is not compatible with the requirements for a C-2H zoning classification. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on October 20, 1991 and in the Mohave Valley News and posted October IS, 1991 as required by Arizona Revised Statutes and Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1991, DENIED this amendment to the South Mohave Valley Area Plan as recomnlended by the Mohave County Planning and Zoning Commission and outlined herein, MORAVE COUNTY BOARD OF SUPERVISORS ~~ ~~~ Lois J.
