RESOLUTION NO. 91-287
A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION
FOR THE APPROVED PRELIMINARY AND FINAL SUBDIVISION PLAT FOR AZTEC
JUNCTION, TRACT 3019, BEING A PORTION OF SECTION 10, TOWNSHIP 21
NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County Board
of Supervisors held on October 21, 1991, a public hearing was
conducted to determine the approval of the Petition of Exception
for streets greater than the approved width within Aztec
Junction, Tract 3019, located in the Golden Valley area, and
WHEREAS, the developer of this tract is Aztec Junction One
Limited Partnership, Jim Kuden, General Partner, of San Diego,
California, and
WHEREAS, the preliminary plat for this tract was approved by
the Mohave County Board of Supervisors on October 3, 1988 via
P&ZC resolution 88-149. The project engineer is an agent of the
developer and has presently filed a final stage of this plat and
improvement plans titled Tract 3019-A, and
WHEREAS, Petition of exception was submitted for the
following Exception:

A. Street widths greater than the approved width.
The special circumstances or conditions which warrant these
deviations from the design standards are as follows:
1. The granting of this petition will not be detrimental to
the public welfare or injurious to other adjacent
properties because:
A. The finished street right-of-way will be increased
from forty (40') feet to fifty (50') feet as shown on
the proposed Urban Standards. Further, ~utility
easements eight (8') feet in width are proposed on
either side within the street right-of-way so that
residents will be provided with utility services.
B. This request will not nullify the intent or purpose
of the General Plan of the County or other
Regulations because the proposed exception will not
effect anything outside of the subject project.
WHEREAS, the petition actually widens the approved street
right-of-way widths from forty (40') feet to fifty (50') feet, to
bring
then
into
acceptable
standards
for
future
county
maintenance.
However, the fifty (50') foot right-of-way width
with the associated paving width of thirty-two (32') feet face of
curb to face of curb does require a petition of exception as they
are not formally adopted in our regulations.
The requested
standard does comport with like Planning and Zoning and Board of
Supervisors approvals granted developers for other tracts, and
WHEREAS, the Commission, at their meeting on Wednesday,
October 9, 1991 recommended APPROVAL of this Petition of
Exception based on the aforementioned justifications.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their special meeting on Monday, October 21, 1991 approved
this petition of exception as recommended by the Commission and
outlined herein.
