V. i.iU No" .li ~ RESOLUTION NO. 91-284 A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR THIRTY (30') FOOT INVERTED CROWN PAVING FOR STREET WIDTHS IN SUN DESERT ESTATES, TRACT 412l, BEING THE NE~ SW~ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on October 21, 1991, a public hearing was conducted to determine the approval of the Petition of Exception for twenty-four (24') foot inverted crown street widths in Sun Desert Estates, Tract 4121, located in the South Mohave Valley area, and WHEREAS, the preliminary subdivision plan for the subject project has been approved by the Board of Supervisors on March 4, 1991. That approval also included the approval of a petition of exception for design of inverted streets in the project. In the past, the County standard for inverted crown streets was for a minimum forty (40') foot wide section. This was used primarily to carry large drainage flows through a project and still provide on-street parking, the design width in this project was intended to be the twenty-four (24') foot minimum pavement which was the minimum of cul-de-sac standard crown sections, and Resolution No. 91~4 . Page 2 PAGE 2 OF ~ BK 1964 PG 33 (FEE~91-58193) WHEREAS, in this project., off-site flows are carried in a forty-eight (48') foot inverted crown street. However, portion of Sun Desert Lane, Van Mouwerik Drive and all of Westwind Drive are thirty (30') feet wide since they carry no off-site flows. In order to maintain consistency, all streets are designed with the same inverted crown section even though not needed for drainage control [without curb and with ditches]. A two ( 2 ' ) foot curb is incorporated in the design which is also consistent with adjacent projects, and WHEREAS, this petition is submitted as a request that the Planning Commission recommend to the Board of Supervisors the granting of an exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent property because the design specifically provides for greater safety and health measures. Due to the nature of the design, there is no impact on adjacent property. 2. This request will not nullify the intent or purpose of the General Plan of the County or other regulations because the design provides for circulation for and use of the property in conformance to the regulations as was ruled previously in the approved petition. 3. The special circumstances or conditions affecting the property are that the adjacent projects are designed with inverted streets with concrete curbs to control drainage and pass drainage through the project without damage and minimize maintenance costs to the County. Consistency with those adjacent projects is a major consideration. The 100-year storm flows are contained within the improved street section, a special feature of the project design. WHEREAS, the Commission, at their meeting on Wednesday, October 9, 1991 recommended APPROVAl. for a MODIFIED Petition of -- Resolution No. 9~84 . Page 3 Exception for Inverted Crown Street Widths that are thirty (30') feet curb face to curb face. The Commission further recommends that the curb section conform to Standard Detail #40, Type lIB" as set forth in the Standard Specifications and Standard Details of the Mohave County Subdivision Regulations. The County Engineer in his recommendation with concurrence of the Planning Staff are attempting to be uniform and consistent when approving Petitions of Exception that relate to Right-of-Way Dedication and pavement widths, and WHEREAS, the Commission, after a full hearing on the matter, was concerned that a twenty-four (24') foot wide paving on local streets could pose a traffic safety hazard as it pertained to ingress and egress of emergency vehicles if parked vehicles were opposite each other, and WHEREAS, the Commission felt that the thirty (30') foot paving width was a compromise for this project (see Exhibit "A"), Moon Valley and Pine River Estates. That future petitions would be at the thirty-two (32') foot paving widths. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, October 21, 1991 approved this modified petition of exception as recommended by the Commission and outlined herein.
