RESOLUTION NO. 91-281 A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR EXCESSIVE BLOCK LENGTH AND EXCESSIVE FRONTAGE LIMITATION WITHIN SUN VALLEY, TRACT 4064, BEING A SUBDIVISION OF A PORTION OF THE SE~ SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST AND NE~ SECTION 1, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on October 21, 1991, a public hearing was conducted to determine the approval of the Petition of Exception for streets less than standard width in Sun Valley, Tract 4064, located in the South Mohave Valley area, and WHEREAS, Sun Valley, Tract 4064-A, is located 1.5 miles east of Highway 95 and is one (1) mile south of Joy Lane and .50 mile north of Boundary Cone Road. This quarter section, or 160 acre site, is south of and adjoins Sun Valley, Tract 4017 and 4018-B, and WHEREAS, Petition of exception was submitted for the following Exceptions: I. Block 24 exceeds the 1,320 foot length requirement set forth in Mohave County Subdivision Regulations, Article 6.6- lA. II. Lot 3, Block 24 exceeds frontage limitation set forth in Mohave County Subdivision Regulations, Article 6.6-1B. ,. Resolution No. 91~1 . Page 2 PAGE 2 OF 4 BK 1964 PG 24 (FEE~91-58190) This petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors that granting of an exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: ITEM I: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because Block 24 is designed in conjunction with the drainage plan to direct the flow into the drainage channel. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations'because the drainage plan meets County Standards and is an acceptable and approved method of controlling and directing runoff. 3. The special circumstances or conditions affecting said property are as follows: a. The design better directs runoff to the drainage channel. b. Additional access to Block 24 would not be desirable due to the major drainage channel which serves this proposed project as well as Desert Lakes and Los Lagos Subdivisions. ITEM II. 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because access and drainage is provided and a VNAE and a wall is provided to limit access to one side of this corner lot, per requirements. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because orderly and planned growth is taken into account as a part of the project. 3. The special circumstances or conditions affecting said property are as follows: a. A wall is to be constructed to limit access to the main arterial. b. A non vehicular access easement is establishf~d on the plat. c. A redesign of this triple frontage corner lot would interfere with the transportation circulation and flow of drainage runoff. .. or- Resolution No. 91~1 . October 9, 1991 recommended APPROVAL of this Petition of Exception with a modification to Item II.3.a., which shall read: "The proposed wall be subject to Commission staff review and be included as part of the improvement plans", and based on the aforementioned justifications. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, October 21, 1991 approved this petition of exception as recommended by the Commission and outlined herein.
