RESOLUTION NO. 91-338
EVALUATION OF A FINAL SUBDIVISION PLAN. OF PINE RIVER ESTATES,
TRACT 4128, BEING A SUBDIVISIQN OF THE N'z. SE'I;: NE'I;: SW'I;: SECTION
25, TOWNSHIP 19 NORTH, RAN,GE 22 WEST, LOCATED IN THE SOUTH MORAVE
VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the special meeting of the Mohave County Board
of Supervisors held on Decelllber161 1991, a public hearing was
conducted to determine the approval of the final subdivision
plan, for PINE RIVER ESTATES, Tract 4128, located in the South
Mohave Valley area, and
WHEREAS, the owner/subdiv~-8er of this tract is Jim Athanas
or I,as vegas, Nevada. The engineer of record on this project is
Chuck Dewald of Territorial Engineers, Incorporated of Bullhead
City, Arizona, and
WHEREAS, this property is located on a five (5) acre parcel
which is located in a portion of the NE'I;: SW'I;: of Section 25,
Township 19 Northl Range 22 West. The subdivision is accessed via
Highway 95 south to Joy Lane, then east approximately one (1)
mile to Mountain View Road, then north approximately one-half
(.5) mile to Hammer Lane, then east apprOximately one-half (.5)
mile to Van Mouwerick, then south one quarter (.25) mile to the
northwest corner of this parcel, and

WHEREAS, the approved preliminary subdivision plan depicts
five (5) acres subdivided into seventeen (17) lots.
The lot
sizes range from 10,000 to 11,250 square feet for an overall
density of 3.38 lots per acre, and
WHEREAS, the developer intends the domestic water supply to
be provided by the Bermuda Water Company to all lots.
Sewage
disposal is proposed to be by individual septic tanks, and
WHEREAS, the approval of this subdivision is based on the
understanding of the Board of supervisors that all streets within
the subdivision shall be constructed and paved with asphaltic
concrete in accordance with Standard Specifications #171 and
101.10A or better; the streets shall include curb and gutter; use
of inverted crowns is accepted, and the owner/subdivider shall
install a water distribution system to serve each lot within the
subdivision; fire hydrants shall be provided in accordance with
the requirements of the Fort Mohave Mesa Fire Department; sewage
disposal is to be handled by individual septic systems; grading
and drainage related improvements will be made as recommended by
the project engineer in the drainage report; arrangements will be
made to extend underground electric, telephone and water service
to each lot in accordance with Arizona Corporation Commission
Regulations; final approval for the completed water system and
the sewage disposal system shall be obtained from the Arizona
Department of Environmental Quality; water availability statement
to be obtained from the Arizona Department of Water Resources;
all lots and street centerline monuments will be staked and

Standard
Specification No. 102; street name and regulation signs will be
installed
in
accordance
with
Mohave
County
Subdivision
Regulations; and as a condition of approval the owner/subdivider
1:-; responsible for the completion of these site improvements and
shall
provide
an assurance
for- all
required
subdivision
improvements in accordance with Article V of the Mohave County
Subdivision Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board APPROVES the
said final plan conditional to the following:
1. The developer will make the same commitments for
improvements in the Subdivision Questionnaire to the
Real Estate Commission as required for approval of this
tract by the Board. A copy of the draft and final
report delivered to the Arizona State Real Estate
Department shall be submitted to the county;

recommended by the project engineer and outlined in the
detailed drainage report as approved by staff;
4. The Final Plat for tract 4128 including the dedication
shall be properly executed and/or sanctioned by all
parties having any recorded title interest in the land
being subdivided and included on this subdivision;
5. An approved method of assurance and/or surety shall be
provided in the amount of the approved cost estimate
for all required site improvements;
6. The original signed copy of the CC&R's shall be
submitted prior to final recordation;
7. Compliance with Board of Supervisors Resolution No. 91-
97 shall be required.

8. Recordation shall be held if prov1s1ons are not made to
insure the access road into this development; via Sun
Desert, Tract 4121, will be improved in the event that
the Sun Desert development is not in place when the
tract is recorded.;
9. provisions shall be made for the acquisition and
dedication of the west one-half (1/2) of Van Mouwerick
Drive, in the event recordation of Sun Desert Estates,
Tract 4121 is not recorded in the same time frame.
This dedication shall be recorded by separate
instrument, prior to this subdivisions recordation.
Furthermore, the docket and page of that document shall
be referenced to on the Final Plat for Pine River,
Tract 4121.
NOW 'l'HEREFORE BE IT FURTHER RESOLVED, corrected copies of
all documents delineated above shall be submitted for staff
review and upon receipt of the evidence that these conditions
have been met, together with the executed mylars and appropriate
recording fees, the Director of Planning and zoning will obtain
the necessary signatures
from the County Departments and
offj,cials and cause the final plat to be recorded.
NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing
has been met and published throughout this subdivision process
and the public was afforded notice of this final action through
advertisement of the Board of Supervisors' meeting for this date.
