PAGE 1 OF 4 HOHAVE COUHTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 91-336 A RESOLUTION SETTING FORTH THE REZONING OF LOT 91, LAKE HIGHLANDS, TRACT 1001, FROM: C-2 (GENERAL COMMERCIAL) PROPOSED TO BE: C-2H (HIGHWAY COMMERCIAL) ZONE, LOCATED LA~E RAVASU CITY AREA, MORAVE COUNTY, ARIZONA RAVASU ZONE, IN THE WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on December 16, 1991, a public hearing was conducted to determine whether approval should be granted to Ralph Kukuk, dba Ralph's Gas Products, of Lake Havasu City, Arizona for a zone change from existing C-2 (General Commercial) zone to C-2H (Highway Commercial) zone, occupying the southeast corner of Bryden and London Bridge Road in the Lake Havasu City area, and WHEREAS, Section 21 is bounded on the north by Chenoweth Drive and is bounded on the south by Lake Havasu City with the west half of the section being bisected by old Highway 95 now known as London Bridge Road. The subject property is accessed from Highway 95 via Lake Drive (the "Busy B" is located at Highway 95 and Lake Drive) thence west approximately .9 miles to a "T" intersection with London Bridge Road thence north approximately .3 miles to the southeast corner of London Bridge ROdd and Bryden Street, and .. ., , . . . BK 4 26 (FEE~91-67638) 2 OF 1985 PG Resolution No. 91-336 Page 2 WHEREAS, review of floodplain map #040058-3110B indicates th is property to be located in a designated flood plain. The property is currently occupied with a car repair business. Surrounding land uses consist of a mixture of commercial and residential uses. A majority of uses on London Bridge Road are commercial uses with residential uses consisting of mobile home and R-V parks, and WHEREAS, this is a zoning violation case. A car repair business requires a C-2H zone under current regulations, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 199 1 , the Conunission recommended APPROVAL of the requested rezoning contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 2. Letter from Mohave County Public Works Engineering Department dated November 12, 1991 From Harold J. Ganyo, P.E., County Engineer, Re: Mohave County Planning & Zoning Commission Agenda. "It is this Departments recommendation that a Record of Survey be required in conjunction with this rezone. It is our concern that there is a discrepancy between the London Bridge Road R/W as platted by ADOT and the west line of Lot 91 as platted by Lake Havasu Highlands, Tract 1001. This discrepancy between the two different right of ways could reduce the size of the platted lot. . , .. , . . PAGE 3 OF BK 1985 PG -4 27 (FEE~91-67638) Page 3 Resolution No. 91-336 3. That a buffer, in the form of a six (6') foot block wall shall be required along the entire boundary where commercial uses and zoning abut residential zones. (Staff would consider an engineered design to assure lot protection and non-access in lieu of a block wall.) 4. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 5. Any open lot storage must be related to or be an accessory to the primary business. 6. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 7. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 8. The applicant supply proof of hookup to an approved community water system and sewage treatment facility. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 2, 1992, as per ARS 11-829E. 10. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ...,:. ,; ',- . . Resolution No. 91-336 rAGE 4 OF 4 BK 1985 PG 28 (FEE~91-67638) Page 4 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, KohdV€ County, Arizona, and in the Havasu Herald, on December 1, i991, and posted November 27, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, December 16, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
