PAGE 1 OF 9 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne 4- RESOLUTION NO. 91-335 A RESOLUTION AMENDING PORTIONS OF THE MORAVE COUNTY SUBDIVISION REGULATIONS AND THE MORAVE COUNTY ZONING REGULATIONS ADDING AND MODIFYING LANGUAGE TO PROVIDE FOR SITE PLAN REQUIREMENTS, GRADING PLANS FOR NEW SUBDIVISION SITES AND AMENDING THE EXISTING STANDARD SPECIFICATIONS AND STANDARD DETAILS FOR MINIMUM STANDARDS FOR INVERTED CROWN CURB ROADWAY DESIGN, MINIMUM STANDARDS FOR CURB ROADWAY DESIGN AND MINIMUM STANDARDS FOR NON CURB ROADWAY DESIGN WHEREAS, at the special meeting of the Mohave County Planning and Zoning Commission held on November 21, 1991 a public hearing was held as a required step in the procedure for a Commission recommendation on amendments to the Mohave County Zoning Regulations and Mohave County Subdivision Regulations to the Board of Supervisors, and WHEREAS, a hearing was held to consider an amendment to the Mohave County Subdivision Regulations, modify to read as follows: IN ACCORDANCE WITH ARTICLE 1.9 OF THE MORAVE COUNTY SUBDIVISION REGULATIONS THE BOARD OF SUPERVISORS WILL CONSIDER THE FOLLOWING AMENDMENTS TO THE MORAVE COUNTY SUBDIVISION REGULATIONS: NOTATION: New Text is shown as: Boldfaced and underlined Old Test is shown as: [3truck] - .... , :: '. . > ~;"'~'~Solution No. 91.5 . AMENDING STANDARD SPECIFICATIONS AND STANDARD DETAILS OF THE MOHAVE COUNTY SUBDIVISION REGULATIONS BY THE DELETION OF THE CURRENT DETAILS: 60, 61, 62 AND 63 AND THE INSERTION OF THE A'rTACHED "NEW" MINIMUM STANDARDS TO BE KNOWN AS "STANDARD DETAIL NO. 60, 61 AND 62. These "NEW" Standard Details are Attached as Exhibit "A", "B" and "C" respectively. THE FOLLOWING CHANGES ARE MADE TO THE MOHAVE COUNTY ZONING REGULATIONS IN ACCORDANCE WITH SECTION 40.1 OF THE MOHAVE COUNTY ZONING REGULATIONS. AMENDING SECTION 27 TO INCLUDE SITE PLAN PROVISIONS P. SITE PLAN REQUIREMENTS 1. SITE PLAN CONDITIONS. Prior to issuance of any building permit for ~ non-residential use, multiple-family use, use proposed in ~ PUD or SD district or use authorized ~ ~ zoning use permit, ~ site plan SHALL BE APPROVED that demonstrates that the use, .!l will be served ~ adequate public facilities; and ~ is compatible with adjoining uses. The site plan required ~ this section shall be submitted in conformance with the concept plan for rezoning applications prIOr to application for ~ building permit and may be reviewed pursuant to the procedures governing that application. ?!: site plan may be prepared and submitted for the entire development a~ one time or for individual development phases. The site plan application will be reviewed ~ the county Planning and Zoning Department, the Public Works Department and the Health Department, and shall be circulated for review ~ utility and public safety providers. 3. CERTIFICATE OF OCCUPANCY. Prior to actual use, ~ certificate to occupy will be issued ~ the County upon satisfactory compliance to the conditions of approval for the site plan. 4. SUBMITTAL REQUIREMENTS. The following information shall be provided with the application for site plan approval. The county may reduce the requirements after ~ presubmittal meeting with the applicant if it determines that the information is not necessary to meet the requirements of this section. 5. SITE PLAN REQUIREMENTS ~ presubmittal meeting with the applicant and the Planning and Zoning staf~ may reduce the level of requirements based on the following criteria: Level of development in the area; Major street or route location; Grading requirements . Drainage considerations; Adjacent Conditions; Submittals wil~ be made to the Planning and Zoning Office and will be reviewed ~ Health Department, Public Works, utility companies and fire department; Ten i.!Ql copies of site plan folded 9" X 12" to fit within file folder; Maximum sheet size - 36" ~ 36"; --- Ownership verification - title report or deed; - Drainage Report (if required); Legal Description, size of parcel; , . . WHEREAS, the notice for public hearing for the Mohave County Planning and Zoning Commission was published in the Kingman Daily Miner, a newspaper of general circulation in the County Seat, the Mohave Valley News, Havasu Herald, Daily Spectrum, and Desert Echo on November 6, 1991 and was posted on November 6, 1991, as required by A.R.S. and the Mohave County Zoning Regulations, and WHEREAS, the Mohave County Planning and Zoning Commission, after review of the proposed changes did resolve at their public ~earing on November 21, 1991 to unanimously recommend approval of this proposal and further recommended the Board approve the same, and WHEREAS, the above recommendation came after lengthy discussions through a community Task Force appointed by the Planning Commission to give a cross section of technical and private citizen input. The Task Force appeared before the Planning Commission with Commission Staff to present the changes to the Regulations in an effort to provide the tools necessary in the current Regulations that addresses urban type growth, and WHEREAS, the notice for public hearing for the Mohave County Board of Supervisors' meeting was published in the Kingman Daily "', f-', I , '~esolution No. 91-4It , Page 6 PAGE 6 OF 9 BK 1985 PG 21 (FEE;91-67637) Miner, a newspaper of general circulation in the County Seat, the Mohave Valley News, Havasu Herald, Daily Spectrum, and Desert Echo on December 1, 1991 and posted November 27 and 29, 1991, as required by A.R.S. and the Mohave County Zoning Regulations, and WHEREAS, the Mohave County Board of Supervisors, after public hearing, did resolve to approve the amendments to the Mohave County Subdivision Regulations and the Mohave County Zoning Regulations as presented by the Mohave County Planning and Zoring Commission, at their special meeting of December 16, 1991, and NOW THEREFORE BE IT RESOLVED, by the Mohave County Board of Supervisors that the amendments as outlined in this Resolution ore hereby approved, and they shall be in effect as of the approval date.
