PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne r~iCR0mMED RESOLUTION NO. 91-326 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE ON LOTS 21 AND 22, BLOCK 147, NEW KINGMAN ADDITION #10, TRACT 1103, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held December 2, 1991 a public hearing was conducted to determine whether approval should be granted to Jack C. and Edna W. Wilson of Lakeside, California for a Zoning Use Permit (ZUP) to establish a residence in a C-2 (General Commercial) zone on Lots 21 & 22, Block 147, New Kingman Addition #10, Tract 1103, occupying the northeast corner of North Lomita Street and Butler Avenue in the Kingman area, and WHEREAS, New Kingman Addition #10, Tract 1103 is located approximately one (1) mile north of the Kingman City limits. The subject property is accessed from Stockton Hill Road, east on Norther Avenue one (1) mile to North Lomita Street. Lots 21 and 22 are adjacent to the east of North Lomita and 260 feet north of Northern Avenue, and WHEREAS, review of floodplain map #040058-2165-C indicates this area to be clear of a designated floodplain. To the south are three (3) small businesses, including a bike store, awning shop and electric shop. A Zoning Use Permit for a residence was issued for the two ( 2 ) lots directly to the north, however, it expired August 6, 1991, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 13, 1991 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. That appropriate zoning/building/environmental permits be obtained. 2. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 3. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 4. PAGE BK 3 OF 3 1979 PG 561 (FEE~91-65081) Page 3 Resolution No. 91-326 after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 17, 1991, and posted November 15, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
