PAGE 1 OF + MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC RESOLUTION NO. 91-324 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF PARCEL 246, STOCKTON HILL RANCHES #8, SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/3A (AGRICULTURAL RESIDENTIAL/THREE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine whether approval should be granted to Ralph E. and valerie L. Sandoval of San Diego, California for a zone change from existing A-R/10A (Agricultural Residential/Ten Acre Minimum Size) A-R/3A (Agricultural Lot zone to Residential/Three Acre Minimum Lot Size) zone, occupying the southeast corner of Ruthe Avenue and Parker Street in the Kingman area, and WHEREAS, Section 36 is located approximately six (6) miles north of the Stockton Hill and Northern Avenue intersection. The subject property is accessed from Stockton Hill Road via Jane Avenue, approximately one and three-quarters (1.75) miles north of Cactus Wren road, east approximately three-quarter (,75) mile to Parker Street thence north approximately one-half (,5) mile to Ruthe Avenue where you will be at the northwest corner of the three (3) lot split at Ruthe Avenue and Parker Street, and . ' . . Resolution No. 91-324 Page 2 PAGE 2 OF ~ BK 1979 PG 552 (FEE~91-65079) WHEREAS, review of floodplain map #040058-2155B indicates this area to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist of mostly vacant land with some homes to the north. The majority of surrounding parcels are approximately forty (40) acres in size wi th one 9 acre and one 29 acre parcel in the section. The applicant desires to split this 12+ acre parcel into three 3+ acre parcels, and WHEREAS, this item was continued from the October 9, 1991 meeting to allow the applicant to address the Commission. Commission Staff recommended denial of this item and the applicant asked his local representative to continue this item in order for him to personally address the Commission, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1991, the Commission recommended conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. These parcels be zoned A-R/3A (Agricultural- Residential/Three Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. " . . . PAGE 3 OF 4 BK 1979 PG 553 (FEE~91-65079) Page 3 Resolution No. 91-324 4. Each parcel shall have legal access. 5. These parcels shall meet or exceed three (3) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage and FEMA designated flood zones. 7. That the Board of Supervisors accept the dedication of a thirty-five (35 ') foot right-of-way and eight (8') foot PUE as they are contiguous to the western and northern property lines of this parcel, being respectively Parker Street and Ruthe Avenue. In addition, a twenty (20 ') foot radius at the intersection of the above mentioned roads. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8 . No building/zoning/environmental permits issued until after Parcel Plat recordation. shall be 9. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being January 2, 1992, as per ARS 11-829E. 11. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 17, 1991, and posted November , . . . NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
