PAGE 1 OF 4 MOHAVE COUHTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC II RESOLUTION NO. 91-323 A RESOLUTION SETTING FORTH THE REZONING OF LOT 26, BLOCK J, LAKE MORAVE COUNTRY CLUB ES'fATES #3, FROM: R-M/1A (MULTIPLE FAMILY RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C- 2/1A (GENERAL COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine whether approval should be granted to Billie J. Williams of Kingman, Arizona for a zone change from existing R-M/1A (Multiple Family Residential/One Acre Minimum Lot Size) zone to C-2 / 1A (General Commercial/One Acre Minimum Lot Size) zone, occupying the southeast corner of Northern Avenue and North Skylark Road in the Kingman area, and WHEREAS, Lake Mohave Country Club Estates #3 is bounded by Northern Avenue, Bank Street, Gordon Avenue and Stockton Hill Road. North Skylark Road is approximately one-half (.5) mile of Stockton Hill Road. The subject property occupies the southeast corner of Northern Avenue and North Skylark Road, and WHEREAS, review of floodplain map #0400S8-216SC indicates this area to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist of commercial --- t" ~>~ ! . The commercial property to the east and north is zoned C-2, the property to the west is zoned C-2H. The residential properties are zoned A-R/1A, and WHEFlliAS, the original R-M zoning has not been utilized for this site and the surrounding uses are viable commercial activities. The applicant desires to establish a recreation center for individuals and groups to uses. The applicant indicated to the Commission that there were no facilities for small groups to meet or have various activities on a small scale. The C-2 zoning makes provisions for an operation of this nature and would not be a major impact on the residential uses to the south with proper buffering, and .,.j '; WHEREAS, this item was continued from the October 9,1991 Planning and Zoning Commission meeting to allow the applicant to address the Commission. A number of surrounding property owners indicated concerns with the proposed project and the Commission continued this item so the applicant could address these concerns, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1991, the Commission recommended APPROVAL of the requested rezoning contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. The Board of Supervisors accept the dedication of a twenty (20') foot radius at the intersection of North Skylark Road arid Northern Avenue through the approval of the resolution authorizing the zone change, and that the dedication statement and dedication be shown on a document acceptable to the Public Works Department. 3. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 4. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or better. 5. Arizona Department of Environmental Quality approves the water supply and distribution system. 6. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 7. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. B. A buffer, in the form of a six (6') foot block wall shall be required along the south boundary where commercial uses and zoning abut residential zones. In addition, provision of a site plan indicating limited access to be approved by staff. Specifically non access on the northwest corner of the parcel extending twenty-five (25') feet from the corner to the south and east via a three (3') foot block wall. 9. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 10. That appropriate zoning/building/environmental permits be obtained. 11. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 2, 1992, as per ARS 11-B29E. 12. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration 0 f this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compLlance wi Lh the sch~dule for development or cause .. . '. ..-,. >, , Resolutflt No. 91-323 . Page 4 the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 17, 1991, and posted November 15, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
