PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 91-321 /), A RESOLUTION SETTING I'ORTH( THE REZONING OF THE E" OF THE SE~ PARCEL 231 ROADWAY EASEMENTJ~, IN SECTION 4, TOWNSHIP 21 NORTH, RANGE IS WEST, FROM: A-R/5A )(AGRICULTURAL RESIDENTIAL FIVE ACRE MINIMUM LOT SIZE) ZOl'!E,PRbPOSED TO BE: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) AND A-R/IA (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine whether approval should be granted to Hamid Zanjani of Anaheim, California for a zone change from existing A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone to A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) and A-R/1A (Agricultural residential/One Acre Minimum Lot Size) zones, occupying the northwest corner of Chino Drive and Mobile Road in the Golden Valley area, and WHEREAS, Section 4 is approximately one-half (.5) mile north of Highway 68 and approximately five (5) miles west of the Highway 68 and 93 junction. The subject property is accessed from highway 68 via Mobile Road North approximately one-half (.5) mile, and " ..... . Resolution No. 91-321 . Page 2 WHEREAS, review of the 2 OF 3 1979 PG 543 (FEE~91-65076) map #040058-2325B PAGE BK floodplain indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist of a mixture of homes and vacant land. The applicant desires to split this 5+ acre parcel into one 2+ acre and two 1+ acre parcels. This property is located within the Valley pioneer Water Company district and the Building Code Area, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on November 13, 1991, the Commission recommended APPROVAL of the requested rezoning contingent upon the following conditions: 1. This parcel be zoned A-R/2A & 1A (Agricultural- Residential/Two One Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two northern parcels shall meet or exceed one (1) acre and the southern parcel meet or exceed two (2) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. The Board of Supervisors accept the abandonment of the existing fifty (50') foot roadway easements along the eastern and southern boundaries of this parcel to be replaced by the dedication of a thirty (30') foot right-of-way along the eastern boundary and a forty-two (42') foot right-of-way along the southern boundary and a twenty (20') foot radius curve at the southeastern corner of this parcel. In addition the granting of a twenty (20') foot PUE along the western boundary of the eastern thirty (30') foot right-of-way and an eight (8') PUE along the southern boundary will be required. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 2, 1992, as per ARS 11-829E. 11. If these conditions are not met within one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 17, 1991, and posted November 15, 1991 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this change in zoning as recommended by the Mohave County and outlined herein.
