A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF PARCEL
324 ROADWAY EASEMENT MAP, BEING THE SE~ SW~ SECTION 20, TOWNSHIP
21 NORTH, RANGE 18 WEST, FROM: A-R/5A (AGRICULTURAL RESIDENTIAL
FIVE ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A
(AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE,
LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 2, 1991, a public hearing was
conducted to determine whether approval should be granted to
Timothy Tate of Santa Ana, California for a zone change from
existing A-R/5A (Agricultural Residential/Five Acre Minimum Lot
Size) zone to A-R/2A (Agricultural Residential/Two Acre Minimum
Lot Size) zone, located 255 feet south of Newgard Drive west of
San Pedro Road in the Golden Valley area, and
WHEREAS, Section 20 is approximately 2.6 miles North of
Highway 68 and approximately six (6) miles west of the Highway 68
and 93 junction.
The subject property is accessed from Highway
68 via Verde Road south approximately 2.6 miles to Bolsa Drive
thence west approximately one-half (.5) mile to San Pedro Road
thence North approximately 670 feet, and

WHEREAS,
the
indicates this parcel to be clear of a designated floodplain.
The property is currently vacant.
Surrounding land uses consist
of a mixture of homes and vacant land. The applicant desires to
split this 5+ acre parcel into two 2+ acre parcels.
This
property is not located within a water or improvement district
but is included within the Building Code area, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on November 13,
19 91, the
Commission recommended APPROVAL of the requested rezoning
contingent upon the following conditions:
1.
This parcel be zoned A-R/2A
Residential/Two Acre Minimum Lot Size).

2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The two parcels shall meet or exceed two (2) acres
exclusive of road easements or rights-af-way.
6. The Parcel Plat shall show any surface drainage or FEMA
flood zones.
7. The Board of Supervisors accept the abandonment of the
existing fifty (50') foot roadway easement along the
eastern boundary of this parcel to be replaced by the
dedication of a thirty-five (35') foot right-of-way,
In addition, the granting of a thirty (30') foot
roadway easement/PUE along the southern boundary of
this parcel. This shall be approved through the
recording of the resolution authorizing this zone
change, and that the dedication/granting statement and
dedication/granting be shown on the Parcel Plat.

No building/zoning/environmental permits

9. That 'appropriate zoning/building/environmental permits
be obtained.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
January 2, 1992, as per ARS 11-829E.
11. I f these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on November 17, 1991, and posted November
15, 1991 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 2, 1991 approved
this change in zoning as recommended by the Mohave County
Planning and zoning Commission and outlined herein.
