PAGE 1 OF 3 MDHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC RESOLUTION NO. 91-315 A RESOLUTION AMENDING RESOLUTIONS 90-15 AND 90-289, PERTAINING TO THE REZONING OF A PORTION OF SECTION 8, TOWNSHIP 16 NORTH, RANGE 19 WEST, LOCATED NORTH OF THE FRANCONIA/I-40 INTERCHANGE IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to amend Resolutions 90-15 and 90-289, pertaining to the rezoning of a portion of Section 8, Township 16 North, Range 19 West, located north of the Franconia/I-40 Interchange in the Mohave County General area, and WHEREAS, Resolution 90-15 was the original zoning resolution which provided for the proposed recycling facility. Resolution 90-289 provided for some modifications to the siting of the facility after the applicant had contacted Arizona Department of Environmental Quality (ADEQ), and WHEREAS, the current request is based on further discussions with the applicant and the following agencies: ADEQ, Federal Emergency Management Agency (FEMA), Atchison Topeka & Santa Fe Railroad (AT&SF), State Historical Preservation Officer (SHPO), As a result of these discussions, the applicant is asking for modifications to the above mentioned resolutions. The changes r .. .. . . Resolution No. 91-315 PAGE 2 OF 3 BK 1979 PG 526 (FEE~91-65070) Page 2 pertain to an increase in size of the site from 415 acres to 455 acres, corresponding legal description changes and flood control measures. The changes do not appear to alter the original intent of Resolutions 90-15 and 90-289, and WHEREAS, the Planning and Zoning Commission at their meeting on November 31, 1991 did recommend APPROVAL of the request for amendments to Resolutions 90-15 and 90-289 as follows (old text is struck, new text is bolded): RESOLUTION 90-15 A RESOLUTION REZONING OF AN APPROXIMATE 4-l:-5- 455 ACRE PARCEL LOCATED NEAR THE FRANCONIA RAIL STATION, NORTH OF I-40 AT MILEPOST 13.5, BEING A--PORTION OF SECTION 8 THE SOUTH 330 FEET OF SECTION 5, ALL OF SECTION 8, AND THE PORTION OF SECTION 17 NORTH OF THE 1-40 RIGHT-OF-WAY, TOWNSHIP 16 NORTH, RANGE 19 WEST, EXCEPTING THE ATCHISON, TOPEKA & SANTA FE RAILWAY RIGHT-OF-WAY AND STATION GROUNDS, FROM: A-R/36A (AGRICULTURAL- RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: M-X (UNLIMITED MANUFACTURING) ZONE, LOCATED IN THE FRANCONIA AREA, MOHAVE COUNTY, ARIZONA 20. That a minimum lot size of ~ 445 acres be established. WHEREAS, this area is a typical desert landscape. This parcel is best accessed by Interstate 40 and/or Route 66 at the Franconia Station Interchange at Mile Post 13.5. It can be located in the South 330 feet of section 5 and Section 8 and the portion of Section 17 north of the 1-40 right-of-way, Township 16 North, Range 19 West. This request for a recycling facility has been continued from previous hearings. The questions, in the past, reference ownership, has been cleared up by the applicant. Concerns that staff had in relation to site development have been addressed by the applicant. Staff and the developer have reached a conditional agreement that relates to the development of the property, and RESOLUTION 90-289 6. The landfill shall be one hundred and twenty (120) acres in size and restricted to a site of ene hundred and 3ixty (160) " \., '" , . '. . . . The perimeters of the landfill shall contain a three hundred (300') foot strip for green belt and flood control and the designated twenty-five (25') foot strip for access and inspection roads. Channels shall be constructed to divert storm water around the site from the flood prone area that currently traverses the site. Flood control will be addressed and approved by ADEQ. The landfill shall be located within the South 330 feet of Section 5 and the North half of Section 8, Township 16 North, Range 19 West, Mohave County, Arizona. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 17, 1991, and posted November 15, 1991 as required by Arizona Revised Statutes and Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991, approved these resolution amendments as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
