RESOLUTION NO. 91-313 A RESOLUTION SETTING FORTH THE REZONING OF LOTS 18, 19 & 20, BERMUDA PLANTATION, BEING A PORTION OF SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, FROM: R-E (RESIDENTIAL RECREATION) ZONE, PROPOSED TO BE: ( S-D) R-M (SPECIAL DEVELOPMENT /MULTIPLE FAMILY RESIDENTIAL) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine whether approval should be granted to William J. & Phyllis C. Owen, John A. & Kathleen G. Owen, Rick James & Pamela Jane Owen, Michael R. Owen, and Michael J. Mangana, all of Monrovia, California for a zone change from existing R-E (Residential Recreation) zone to (S-D)R-M (Special Development/Multiple Family Residential) zone, located three hundred sixty (360') feet west of River Avenue, south of Levee Drive, in the South Mohave Valley area, and WHEREAS, Bermuda Meadows subdivision is located approximately thirteen (13) miles south of Bullhead City's southern limits and is accessed from Highway 95 via Harbor Avenue at Higgen's Corner south to Levee Drive. The subject property is accessed from Harbor Avenue via Meadow Drive thence east approximately 100 feet on the north side of the street, and . ... , \ . Resolution No. 91-313 Page 2 PAGE 2 OF 4 BK 1979 PG 519 (FEE~91-65068) WHEREAS, review of floodplain map #040058-2615C' indicates this area to be in a minor and major designated flood zone. The property is currently occupied. Surrounding land uses consist of a mixture of residences and vacant land with the Colorado River to the south. A proposed subdivision named Mauna Kea to the north is being processed by the applicant. The subject property extends from Levee Drive south across Dike Road to the river. The proposed site plan indicates a duplex on Lot 18 and a tri- plex on Lots 19 & 20 for a total of five (5) units for the three (3) lots, and WHEREAS, at the public hearing before the Mohave County 1991, the Planning and Zoning Commission on November 13, Commission recommended APPROVAL of the requested rezoning contingent upon the following conditions: NOTE: 1. The applicant comply with all applicable provlslons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). The ZONING PLAN be approved for a (S-D) R-M/ 1 & 2A (Special Development/Multiple Family Residential/One & Two Acre Minimum Lot Size) zone in accordance with Section 19 of the Mohave County Zoning Regulations. The one acre minimum shall apply to Lot 18. The two acre minimum lot size shall apply to Lots 19 & 20 as they are combined by the applicant. 2. THE FOLLOWING 4 ITEMS APPLY TO THE SPECIAL DEVELOPMENT ZONING REQUIREMENTS, 3. The owner accepts that whenever a "S-D" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. .... ~. ~ NOTE: NOTE: . Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 5. Staff will maintain the most current approved ZONING PLAN on file in the master zoning folder for reviews. 6. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, Section 11-832. THE FOLLOWING REQUIREMENTS. 3 TO ENVIRONMENTAL ITEMS APPLY 7. Arizona Department of Environmental Quality approves the water supply and distribution system. 8 . Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 9 . Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. THE FOLLOWING 2 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 10. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 11. The applicant shall pave all driveway access, roadways and parking in accordance with Mohave County Standard Specification #171, or better. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 12. That appropriate zoning/building/environmental permits be obtained. 13. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, Being January 2, 1992, as per ARS 11-829E. 14. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance wi Lh the schedule for development or cause .0 .... .... Page 4 PAGE 4 OF 4 BK 1979 PG 521 (FEE~91-65068) the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, and in the Mohave Valley News, on November 17, 1991, and posted November 15, 1991 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
