PAGE 1 OF 3 NOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 91-309 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A SALES OFFICE IN A (S-D)R (SPECIAL DEVELOPMENT RESIDENTIAL) ZONE ON A PORTION OF THE NW~ NW~ SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held December 2, 1991 a public hearing was conducted to determine whether approval should be granted to Frank Passantino, LOS LAGOS, a Limited Partnership, of Fort Mo j ave, Arizona for a zoning Use Permit (ZUP) to establish a sales office on a portion of the NW~ NW~ Section 1, Township 18 North, Range 22 West, occupying the southeast corner of Lipan Boulevard and Mountain View Road, in the South Mohave valley area, and WlIEREAS, Section 1 is located four (4) miles south of Bullhead City's southern most border and one (1) mile east of Highway 95. The subject property is accessed from Highway 95 via Lipan Boulevard east one ( 1) mile to the Mountain View Road thence south approximately two hundred (200') feet on the east side of the road, and -, .. Resolution No. 91~9 . Page 2 PAGE 2 OF 3 BK 1979 PG 507 (FEE~91-65064) WHEREAS, review of floodplain map #040058-2445C indicates portions of this area lies within a designated floodplain. The site is currently vacant. Surrounding land uses consist of Desert Lakes Tract 4046 to the north, Sun Valley Tract 4064 to the eas t and Fort Mojave Indian Reservation land to the west. The applicant desires to establish a temporary sales office at this location until the clubhouse for Los Logos, Tract 4096-A can be built, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 13, 1991 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. This permit shall be a temporary permit for a one year period with provision for one extension of one year. 2. The site shall have appropriate landscaping for the surroundings and shall provide temporary adequate off- street parking as provided in the site plan. 3. At the expiration of this approval the property shall revert to original zoning and condition except such improvements that can be incorporated into the parcel's future use i.e. sidewalk, PUE's, paved parking, access. 4. The mobile home shall have an affixed HUD label. 5. The mobile home shall be used as a sales office only and not as a residence or watchman's quarters. 6. The access and parking area be paved if the sales office use extends beyond one (1) year from the date of Board approval. 7. Appropriate zoning/building/environmental permits be obtained. 8. Appropriate signage permits be obtained. 9. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall V~n\linate at that date. ....' l. ~ Resolution N~91-309 . This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 11. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona and Mohave Valley News, on November 17, 1991, and posted November 15, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
