RESOLUTION NO. 91-307 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF SECTION 22, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS RIO POINTE, TRACT 4140, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: (S-D)C-2/C-2H/C-MO/C-RE/R-M/R-O/M (SPECIAL DEVELOPMENT GENERAL COMMERCIAL/HIGHWAY COMMERCIAL/COMMERCIAL MANUFACTURING OPEN LOT STORAGE/COMMERCIAL RECREATION/MULTIPLE RESIDENTIAL/SINGLE FAMILY RESIDENTIAL MOBILE HOMES PROHIBITED/ MANUFACTURING) ZONES, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine whether approval should be granted to Thomas Coury of Trans World Real Estate & Investments, Inc., Mesa Arizona for a zone change from existing A-R (Agricultural Residential) zone to (S-D) C-2 /C-2H/C-MO /C-RE/R-M/R-O /M (Special Development General Commercial/Highway Commercial/Commercial Manufacturing Open Lot Storage/Commercial Recreation/Multiple Residential/Single Family Residential Mobile Homes Prohibited/Manufacturing) zones. Section 22 is bounded by Highway 95, Camp Mohave Road, El Rodeo Road (extension) and Fort Mojave reservation land, located in the South Mohave Valley area, and WHEREAS, Section 22 is located one (1) mile south of Bullhead City's southern most boundary and is bounded by Highway . Resolution No. 91-307 . Page 2 PAGE 2 OF 6 BK 1979 PG 498 <FEE~91-65062) 95, Camp Mohave Road, EI Rodeo Road (extension) and Fort Mojave reservation land. This proposed subdivision occupies three quarters (.75) of the section, and WHEREAS, review of floodplain map #040058-2445C indicates portions of this area lies within designated floodplains. The site is currently vacant except for a previously approved sales office. Surrounding land uses consist of Camp Mohave Unit I & 2 in the NE~ NE~ of the section; Mohave Valley Mall, Tract 4118 in the SE~ NE~ of the section; with Fort Mojave Indian Reservation land to the west and Le Clair Acres subdivision to the north, and WHEREAS, the preliminary subdivision plan depicts approximately two hundred forty-three (243) acres divided into forty-six (46) individual lots. The minimum lot size will be approximately 1.19 acres and a maximum of forty (40) acres, and WHEREAS, the current zoning is A-R (Agricultural Residential) . The developer's proposed zoning includes Special Development categories of: C-2 (General Commercial), C-2H (Highway Commercial), C-MO (Commercial Manufacturing/ Open Lot Storage) , R-O/6A (Single Family Residential/ Mobile Homes prohibi ted/ Six Acre Minimum Lot Size), R-M (Multiple Family Residential), C-RE (Commercial Recreation) and M (General Manufacturing) . The residential uses will be located in the northern portion of the project with the remaining majority being a mixture of commercial uses with a manufacturing site set aside for the express purpose of hous ing a sewage treatment Resolution No. 91~7 . Page 3 PAGE 3 OF 6 BK 1979 PG 499 (FEE~91-65062) facility on Lots 12-16 and Lots 17-21 are approved for manufacturing uses, however, each and every specified use will have to be further approved through the public hearing process, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1991, the Commission recommended APPROVAL of the requested rezoning contingent upon the following conditions: 1. The ZONING PLAN be approved for a (S-D) R-O (Special Development/Single Family Residen~ial Mobile Homes prohibited/Fifteen Acre Minimum Lot Size) zone in accordance with Section 19 of the Mohave County Zoning Regulations. The ZONING PLAN be approved for a (S-D) C-2H (Spec ial Development/Highway Commercial/Minimum Lot Size based on size of platted lots) zone in accordance with Section 19 of the Mohave County Zoning Regulations. This shall apply to Lots 1, 2, 3, 4, 5, 6, 7, 25, 26, 27,28,29, 30, 46, 47 & 48. 8. The ZONING PLAN be approved for a (S-D) C-MO (Special Development/Commercial Manufacturing Open Lot Storage/ Minimum Lot Size based on size of platted lots) zone in accordance with Section 19 of the Mohave County zoning Regulations. This shall apply to Lots 8, 9, 10, 11. 9. The ZONING PLAN be approved for a (S-D)M (Special Development/ General Manufacturing/ Minimum Lot Size based on size of platted lots) zone in accordance with Section 19 of the Mohave County Zoning Regulations. This shall apply to Lots 12, 13, 14, 15, 16 17, 18, 19, 20, 21. The applicant has requested this zone to facilitate the placement of a sewage treatment plant (Lots 12-16). Lots 17-21 shall require that each and every specific use would be approved through the public hearing process PRIOR to issuance of any Building/ Zoning/Environmental permits. Steps have been taken to modify the area plan to take into consideration this modification. NOTE: THE FOLLOWING 4 ITEMS APPLY TO THE ~PECIAL DEVELOPMENT ZONING REQUIREMENTS. 10. The owner accepts that whenever a "S-D" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 11. Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 12. Staff will maintain the most current approved ZONING PLAN on file in the master zoning folder for reviews. 13. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 17 . Any remainder of the lots not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 18. A buffer, in the form of a six (6') foot block wall shall be required along the entire boundary where commercial & residential/multifamily or multifamily & residential uses and zoning abut except approved entrance points. (Staff would consider an engineered design to assure lot protection and non-access in lieu of a block wall.) 19. A buffer, in the form of a six (6') foot block wall shall be required along the entire boundary of manufacturing uses and zoning except approved entrance points. If the wastewater treatment facility is constructed a buffer, in the form of an eight (8') foot block wall shall be required along the entire boundary including Parcel I (El Rodeo Drain Channel). 20. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Page 6 PAGE 6 OF 6 BK 1979 PG 502 (FEE~91-65062) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, and in the Mohave Valley News, on November 17, 1991, and posted November 15, 1991 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
