PAGE 1 OF 7 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-306 EVALUATION OF A FINAL SUBDIVISION PLAN OF BEAVER DAM ESTATES, TRACT 3034-A, BEING A SUBDIVISION OF THE NE~ NE~ SECTION 5, TOWNSHIP 40 NORTH, RANGE 15 WEST, LOCATED IN THE ARIZONA STRIP, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine the approval of the final subdivision plan, for Beaver Dam Estates, Tract 3034-A, located in the South Mohave Valley area, and WHEREAS, the owner/subdivider of this tract is John Hanley of Mesquite, Nevada. The engineer of record on this project is L. R. Pope Engineers and Surveyors, of St. George, Utah, and WHEREAS, this property is located approximately one half (~) mile north of Interstate 15, where it fronts along the east side of old Highway 91 and is on the north side of the Beaver Dam wash and the Beaver Dam Lodge. Access to this project will be provided directly off of Highway 91, and WHEREAS, the approved preliminary subdivision plan depicts fifteen (15) acres subdivided into forty-eight (48) lots. The lot sizes range from 6,000 to 8,783 square feet for an overall ~-- Resolution No. 9~06 . Page 2 density of 3.16 lots per acre: PAGE 2 OF 7 BK 1979 PG 491 (FEE~91-65061) This project also includes approximately eight (8) acres of open space, and WHEREAS, the developer is intending to install a sewage treatment plant, filter and storage pond. The developer further intends the domestic water supply to be provided by an on-site well. However, the Arizona Corporation Commission is currently evaluating whether or not, the entity purveying this water supply will be public or private, and WHEREAS, the approval of this subdivision is based on the understanding of the Board of Supervisors that all streets within the subdivision shall be constructed and paved with asphaltic concrete in accordance with Standard Specifications #171 and 101.10A or better; the streets shall include curb and gutter; and the owner/subdivider shall install a water distribution system to serve each lot within the subdivision; fire hydrants shall be provided in accordance with the requirements of the Mohave County Subdivision Regulations; sewage disposal is to be handled by a sewage treatment facility to be located on Parcel "F"; grading and drainage related improvements will be made as recommended by the project engineer in the drainage report; arrangements will be made to extend underground electric, telephone and water service to each lot in accordance with Arizona Corporation Commission Regulations; final approval for the completed water system and the sewage treatment plant shall be obtained from the Arizona Department of Environmental Quality; water availability statement to be obtained from the l\rizona Department of Water Resources; Resolution No. 91~6 . Page 3 PAGE 3 OF 7 BK 1979 PG 492 (FEE~91-65061) all lots and street centerline monumentS will be staked and monumented in accordance with Mohave County Standard Specification No. 102; street name and regulation signs will be installed in accordance with Mohave County Subdivision Regulations; and as a condition of approval the owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board APPROVES the said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the Subdivision Questionnaire to the Real Estate Commission as required for approval of this tract by the Board. A copy of the draft and final report delivered to the Arizona State Real Estate Department shall be submitted to the county; 2. Arizona Department of the water and sewer subdivision; Environmental Quality approves system installation for this 3. The owner/subdivider shall cause the engineering and drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report as approved by staff. These improvements shall include any applicable comments within the Public Works letter dated November 22, 1991 ( exhibit A); 4. The Final Plat for tract 3034-A including the dedication shall be properly executed and/or sanctjoned by all parties having any recorded title interest in the land being subdivided and included on this subdivision; 5. The owner/subdivider shall obtain a report from the Arizona Department of Water Resources, indicating that the water supply has been found to be adequate to meet the needs of this subdivision prior to recording the final plat; .~ Resolution N~91-306 . The owner/subdivider shall obtain a report from the Arizona Corporation Commission, determining the status of the Beaver Dam Estates Homeowners Association in regards to the administration of the water system as a public or private service corporation. If so required, a Certificate of Convenience and Necessity (CC&N) shall be obtained; 7. Applicant shall obtain a franchise from the Mohave County Board of Supervisors for their water and sewer service area; 8. The cost estimate, in addition to the assurance, shall be revised to reflect the conditions set forth by the Public Works letter dated November 22, 1991 (exhibit A) . Furthermore, the cost estimate and the corresponding assurance shall reflect any additional cost stipulated by the Mohave County Public Works Department; 9. An approved method of assurance and/or surety shall be provided in the amount of the approved cost estimate for all required site improvements; 10. Lot 26 shall not be used for residential purposes until the well is capped and closed. Furthermore, the special easements pertinent to the "well" shall be extinguished; 11. NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing has been met and published throughout this subdivision process and the public was afforded notice of this final action through advertisement of the Board of Supervisors' meeting for this date. The description labelling HWY 91 as a county highway is not adequate. 2. It appears from reviewing this map that these corners were proportioned between the Northwest Closing Corner of Section 5 and the South 1/4 Corner of Section 33. According the 1973 BLM Manual Article 5-35(2) the Standard corners control both alignment and proportional measurement along the line. In other words the proportion should have been made between the Southwest Corner of Section 32 and the South 1/4 Corner of Section 33. Since the found monument at Northwest Corner of Section 5 is a Closing Corner it is not considered a controlling monument in reestablishing the location of the missing monuments to the East. . '.
