PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-305 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE SW~ SE~ SECTION 32, TOWNSHIP 40 NORTH, RANGE 16 WEST, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: (S-D)C-RE (SPECIAL DEVELOPMENT COMMERCIAL RECREATION) ZONE, LOCATED IN THE ARIZONA STRIP AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1991, a public hearing was conducted to determine whether approval should be granted to ADAVEN, Incorporated of Mesquite, Nevada for a zone change from existing A-R (Agricultural Residential) zone to (S-D)C-RE (Special Development Commercial Recreation) zone, located west of the Peppermill Palms Golf Course and south of "Old U.S." Highway 91 in the Arizona Strip area, and WHEREAS, Section 32 is located directly east of Mesquite, Nevada and the primary access to this site from Interstate 15 (1- 15) is through the North Mesquite-Interstate 15 interchange thence east on Highway 91 approximately one-half (.5) mile, and WHEREAS, review of floodplain map #040058-02008 indicates this area to be clear of a designated floodplain, This site is currently vacant and bordered on the north by Interstate 15, a mobile home park on the west, the Peppermill Golf Course on the Resolution No. 91~5 . Page 2 PAGE 2 OF 4 BK 1979 PG 487 (FEE~91-65060) east, and vacant land to the south. The property is currently zoned A-R. The owner is requesting a zone change to (S-D)C-RE (Commercial-Recreation) to allow for a recreation vehicle (R-V) park with the proposed name of Sonita village R-V Resort. The size of this development is approximately twenty-six (26) acres. The developer proposes 347 R-V spaces, a store, storage area, wastewater treatment plant and a club house as part of a 76,000+ square foot recreation area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1991, the Commission recommended APPROVAL of the requested rezoning contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. The applicant submit requisite plans and reports in accordance with Section 27.J of the Mohave County Regulations, or its successor, for review and approval by the Commission and Board of Supervisors. 3. These lots will not be for sale unless or until they have been approved as subdivided parcels by Mohave County Planning and Zoning and have met all requirements of the State of Arizona. 4. The applicant submit copy of agreement(s) between the State Land Department concerning lease transfer from Jimmie Hughes to Adaven Corporation or new lease for Adaven Corporation and approval for use of this property for a R-V park. 5. The ZONING PLAN be approved for a (S-D)C-RE/20A (Special Development/Commercial Recreation/Twenty Acre Minimum Lot Size) zone in accordance with Section 19 of the Mohave County Zoning Regulations. " Resolution No. 91~5 . Page 3 NOTE: PAGE 3 OF 4 BK 1979 PG 488 (FEE~91-65060) THE FOLLOWING 4 ITEMS APPLY TO THE SPECIAL DEVELOPMENT ZONING REQUIREMENTS. 6 . The owner accepts that whenever a "S-D" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 7 . Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 12. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. NOTE: THE FOLLOWING 3 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 13. Adequate parking shall be implemented in accordance with the Mohave County zoning Ordinance. 14. A one (I') foot vehicle non-access easement (VNE) shall be established along the north boundary of this parcel contiguous to Highway 91's southern right-of-way except approved access points and that the granting statement be shown on a separate document acceptable to the Public Works Department. A six (6') foot block wall shall be required along this easement. (Commission Staff would consider an engineered design to assure lot protection and non-access in lieu of a block wall.) 15. The applicant shall pave all driveway access, roadways, pads and parking in accordance with Mohave County Standard Specification #171, or better. Resolution No. 91-~5 ,.".. A buffer, in the form of a six (6') foot block wall shall be required along the boundaries of this parcel except approved access points. (Commission Staff would consider an engineered design to assure lot protection and non-access in lieu of a block wall.) 17. That appropriate zoning/building/environmental permits be obtained. 18. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 2, 1992, as per ARS 11-829E. 19. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, and in the Mohave Valley News, on November 17, 1991, and posted November 15, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1991 approved this change in zoning as recommended by the Mohave County g Commission and outlined herein.
