A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION
FOR SINGLE TIERED LOTS WITH VEHICLE NON-ACCESS EASEMENTS AND
STREETS LESS THAN STANDARD WIDTH RIGHT-OF-WAY FOR BEAVER DAM
OASIS, r.rRACT 3502, LOCATED IN THE ARIZONA STRIP AREA, MORAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 2, 1991, a public hearing was
conducted to determine the approval of the Petition of Exception
for single tiered lots with vehicle non-access easements and
streets less than standard width right-of-way for Beaver Dam
Oasis,
Tract
3502,
located
adjacent
to' Arizona Avenue,
approximately five hundred (500') feet from County Highway 91 in
the Beaver Dam portion of the Arizona strip, and
WHEREAS, this petition of exception is for single tiered
lots with vehicle non-access easements and fifty (50') foot
right-of-way on McKnight Road, which is the main access to this
subdivision.
The size of the proposed development is 11.362
acres to be subdivided into nine (9) lots of one (1) acre or
larger. Water will be the individual lot owner's responsibility.

WHEREAS, the following Petitions for Exception have been
requested:
I. Single tiered lots with vehicle non-access easements,
including, lots 1,6,7,8, and 9.
II. McKnight Road will be 50 feet rather than 60 feet.
This petition is submitted as a request that the Planning
and Zoning Commission recommend to the Board of Supervisors
that granting of an exception from the Subdivision
Regulations as outlined in Article 1.13 for the following
reasons:
ITEM I.
1. The granting of this petition will not be detrimental
to the public welfare or injurious to other adjacent
properties because a physical barrier will be provided.
2. This request will not nullify the intent or purpose of
the Master Plan of the County or other regulations
because orderly and planned growth is taken into
account as a part of the project.
3. The special circumstances or conditions affecting said
property are provided for by physical barriers.
ITEM II.
1. The granting of this petition will not be detrimental
to the public welfare or injurious to other adjacent
properties because the developer has provided for
dedication of additional right-of-way on Arizona
Avenue.
2. This request will not nullify the intent or purpose of
the Master Plan of the County or other regulations
because the property to the south can dedicate an
additional 10 feet when ready to develop.
3. The special circumstances or conditions affecting said
property, include, a 50 ft. on-site cul-de-sac with
large lots and access is adequate.

WHEREAS, the Commission, at their meeting on Wednesday,
November 13, 1991 recommended APPROVAL of this Petition of
Exception based on the aforementioned justifications.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 2, 1991 approved
this petition of exception as recommended by the Commission and
outlined herein.
