PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He . ?4ICROALMW -, I 5 RESOLUTION NO. 92-29 A RESOLUTION SETTING FORTH CONDITIONAL APPROVAL OF A REQUEST OF ABANDONMENT TO REDUCE THE EASTERN PORTION OF RIGHT-OF-WAY FOR RIVERFRONT PARKWAY TO TWENTY-TWO (22 ') FEET IN SECTION 23, TOWNSHIP 17 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUN'rY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held February 3, 1992 a public hearing was conducted to determine whether approval should be granted to Frank Curcio of River Terrace Estates in Mohave Valley, Arizona, for abandonment to reduce the eastern portion of right-of-way for Riverfront Parkway to twenty-two (22') feet, located in the South Mohave Valley area, and WHEREAS, Section 23 is located thirteen (13) miles south of Bullhead City's southernmost border. Access to Section 23 is from State Highway 95 and Higgen's Corner, south one (1) mile to the intersection of Barrackman Road and Plantation Drive. Section 23 is bounded by Plantation Drive on the north, Mountain View Road on the east, Riverfront Parkway and the Colorado River on the west, with vacant, undeveloped land on the south. PAG~ 2 OF 4 BY. 2004 PG 125 (FEE~92- 6146) Resolution No. 92-29 Page 2 WHEREAS, Riverfront Parkway extends south from the Barrackman Road Plantation Drive intersection. It was previously named the Mohave Valley Highway and was part of an extended traffic network which at one time crossed a wooden one-way Bureau of Reclamation material hauling bridge into Needles, California. This bridge has since been removed and the roadway dead-ends at the Wildlife Refuge. This road is a dike road and is slated to serve four (4) proposed subdivisions, and WHEREAS, the applicant has requested this change in order to facilitate the development of The Coves at River Terrace, Tract 4139. The applicant is requesting that a portion of the eastern half of the right-of-way be abandoned. This abandonment would facilitate the erection of a wall on the ridge of the dike rather than at the bottom of the slope. The wall is part of the proposed development and would be a security wall as well as a non-access barrier for double frontage 10ts, and WHEREAS, this request was continued from the December 11, 1991 Planning and Zoning Commission meeting in order to allow two agencies, County Public Works Department and the U.S. Bureau of Reclamation, additional time to submit comments, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on January 8, 1992 did generate a .0:, ,(,/ . . The abandonment final plat of Tract 4139. take place the proposed upon recordation of the Coves at River Terrace, 2. The Bureau of Reclamation has indicated that the integrity of the levee must be maintained. The developer shall ensure provisions be made that excavation of any material on the side slope of the levee be prohibited. Subsequent owners shall be so informed. 3. Special building setbacks should be implemented to prevent incursions on or near the slope of the levee. 4. Developer shall coordinate with local utilities to ensure adequate easements are provided. Citizens Utilities Phone Division and Mohave Electric Cooperative have indicated such action will be needed. FMTUA will also need to be contacted regarding water and sewer facilities. 5. The preliminary plat and final plat shall accurately indicate the results of this action. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 19 and 26, 1992, and in the Mohave valley News, and posted January 17, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. .. --~ ...) .. . . PAGE 4 OF 4 BK 200~ PG 127 (FEE~92- 6146) Resolution No. 92-29 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3, 1992 approved this abandonment request as recommended by the Mohave County Planning and Zoning Commission, subject to the condition outlined herein.
