PAGE 1 OF 3 HOHAV~ COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne MICROFIlMED RESOLUTION NO. 92-17 A RESOLUTION SETTING FORTH THE REZONING OF LOTS 21-24, BLOCK 163, NEW KINGMAN ADDITION UNIT 10, TRACT 1103, FROM: (S-D)C-l (SPECIAL DEVELOPMENT/NEIGHBORHOOD COMMERCIAL) ZONE, PROPOSED TO BE: R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6, 1992, a public hearing was conducted to determine whether approval should be granted to William S. Militello of Kingman, Arizona for a zone change from existing (S-D) C-1 (Special Development/Neighborhood Commercial) zone to R-O (Single Family Residential/Mobile Homes Prohibited) zone, located one hundred ten (110') feet east of North Bond Street on Carver Avenue in the Kingman area, and WHEREAS, Block 163 is approximately one (1) mile north of Northern Avenue and approximately one (1) mile east of Stockton Hill Road. Access to the subject property from Northern Avenue is via North Bond Street, and WHEREAS, review of floodplain map #040058-2165C indicates this area to be in a designated minor floodplain. The lots are currently vacant. Surrounding land uses consist of mostly homes and vacant land with two (2) apartment buildings to the ., - . . Resolution No. 92-17 Page 2 PAGE 2 OF 3 BK 1992 PG 566 (FEEt92- 1089) northeast. Commission staff received one (1) objection to this request. The owner of Lots 19 & 20 indicated he was opposed to any residential activity on the adjacent lots. In view of the residential character of the street and adjacent area, the Commission did not see any significant problems with a request to convert vacant commercial lots into viable residential lots, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1991, the Commission recommended APPROVAL of the proposed zone change and resultant lot split contingent upon the following conditions: 1. A buffer, in the form of a six (6 ') foot block wall shall be required along the entire boundary where commercial & residential uses and zoning abut. (Co~uission Staff may consider an engineered design to assure lot protection and non-access in lieu of a block wall. ) 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, TiLle .1.1, Cha~ter 6, 11-832. .. -: . . Resolution No. 92-17 PAGE 3 OF 3 BK 1992 PG 567 (FEEt92- 1089) Page 3 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on December 22, 1991, and posted December 20, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1992 approved this change in zoning as recommended by the Mohave County Planning and zoning Co~nission and outlined herein.
