PAGE 1 OF 3 NOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 92-13 A RESOLUTION SETTING FORTH THE REZONING OF THE NW~ SW~ PARCEL 101 RECORD OF SURVEY FOR SECTION 14, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/10A (AGRICULTURAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6, 1992, a public hearing was conducted to determine whether approval should be granted to Dennis and Shirley Tucker of Kingman, Arizona for a zone change from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/IA (Agricultural Residential/One Acre Minimum Lot Size) zone, located 330 feet north of Collins Drive east of Houck Road in the Golden Valley area, and WHEREAS, Section 14 is approximately one-half (.5) mile south of Highway 68 and approximately three (3) miles west of the Highway 68 and 93 junction. The subject property is accessed from Highway 68 via Bacobi Road south approximately one (1) mile, to Collins Road, then west approximately one-quarter (.25) mile to Houck Road then north approximately 330 feet, and WHEREAS, review of the floodplain map #040058-2325B indicates .this parcel to be clear of a designated floodplain. Surrounding land uses consist of a mixture of homes and vacant land. This two and one-half (2.5) acre parcel was illegally split through escrow in 1989. The applicant has been very cooperative in their effort to alleviate the problem via the rezoning process. The applicant desires to split this 2+ acre parcel into two 1+ acre parcels. This property is located within the Valley Pioneer Water Co. district and is within the Building Code Overlay Zone area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1991, the Commission recommended APPROVAL of the proposed zone change and resultant lot split contingent upon the following conditions: 1. The two parcels be zoned A-R/1A Residential/One Acre Minimum Lot Size). (Agricultural- 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two parcels shall meet or exceed one ( 1) acre exclusive of road easements or road rights-of-way. 6. The lot lines shall be drawn to provide correct setbacks for existing structures. 7. The Parcel Plat shall show any surface drainage or FEMA flood zones. 8. The Board of Supervisors accept the dedication of a thirty (30') foot road right-of-way along the west boundary of this parcel. In addition, the granting of an eight (8') foot PUE along the west boundary of this propel.-ty. Page 3 PAGE 3 OF 3 BK 1992 PG 55~ (FEE~92- 1085) dedication/granting be shown on the parcel Plat. 9. No building/zoning permits shall be issued until after Parcel Plat recordation. 10. That appropriate zoning/building/environmental permits be obtained. 11. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being February 6, 1991, as per ARS 11-B29E. 12. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on December 22, 1991, and posted December 20, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1992 approved this change in zoning as recommended by the Mohave County Planning and and outlined herein.
