PAGE 1 OF 3 ~~HAVE ~OUNTY BOARD OF SUPERVISORS R~CORDING FEE 0.00 Ne RESOLUTION NO. 92-9 A RESOLUTION AMENDING RESOLUTION 91-227, PERTAINING TO A PETITION OF EXCEPTION REQUESTING THIRTY-TWO (32') FOOT CURB FACE TO CURB FACE, INVERTED CROWN STREETS IN SUNSET RANCHOS, TRACT 4046-C, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6, 1992, a public hearing was conducted to amend Board of Supervisors Resolution No. 91-227 pertaining to a petition of exception requesting thirty-two (32') foot curb face to curb face, inverted crown streets in Sunset Ranchos, Tract 4046-C, being a portion of the W~ of the N~ Section 13, Township 19 North, Range 22 West, in the South Mohave Valley area, and WHEREAS, the owner/developer of this project, formerly known as T ierra Grande, is Sunset Ranchos, an Arizona Inc. , Partnership. The engineer of record is Jack L. Stovall of Stovall Engineers, Inc. who is responsible for the plan preparation and drainage study, and WHEREAS, the access to the project is approximately one (1) mile east of Highway 95, along Camp Mohave Road to Mountain View Road, then one-half (.5) mile north on Mountain View to Valencia Road alignment to this tract, and ... Resolution No. ~9 . Page 2 PAGE 2 OF 3 BK 1992 PG 541 (FEE~92- 1081) WHEREAS, this development is 94 acres with a total of 284 lots. The minimum lot size is 8,000 square with the maximum lot size of 16,500 square feet. The overall density is 3.02 lots per acre. The project is proposed to be serviced by individual septic systems. The water will be provided by Bermuda Water Company. Electricity will be provided by Mohave Electric Co-op., and WHEREAS, this tract was originally approved via Board Of Supervisors Resolution No. 90-166, and due to substantial changes in the plan, was subsequently approved as revised via Board Of Supervisors Resolution No. 91-227. The petition of exception submitted June 12, 1991, requested approval of several deficiencies which were referenced and approved by both of the above Resolutions, however, Commission staff inadvertently left out the request for: I. Inverted streets with 32' (thirty-two foot) paving width, curb face to curb face. WHEREAS, this petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of an exception from the Subdivision regulations as outlined in Article 1.13 for the following reasons: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because overall drainage is being provided within the pavement. The request will not nullify the intent or purpose of the Master Plan of the County or other regulations because required right-of-way widths are per Mohave County standards and overall drainage is provided. 3. The special circumstances or conditions affecting said property are as follows: Street sections are designed to carry the 100 year storm within the pavement. Due to the drainage des ign on the overall subdivision a 32' paved section inverted with curb is adequate. WHEREAS, the Planning and Zoning Commission, at their meeting on December 11, 1991, did recommend APPROVAL of this petition of exception based on the aforementioned justifications. The street detail shown on the improvement plans will need to reflect the approved street section proposed for this development, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on December 22, 1991, and in the Mohave Valley News, and posted December 20, 1991 as required by Arizona Revised Statutes and Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1992, approved this resolution amendment as recommended by the Mohave County Commission and outlined herein.
