PAGE 1 OF 3 nOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-7 A RESOLUTION DENYING THE REZONING OF E~ NE~ NW~ SE~ SECTION 25, TOWNSHIP 18 NORTH, RANGE 22 WEST, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: R-E (RESIDENTIAL RECREATION) ZONE, LOCA'l'ED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6, 1992, a public hearing was conducted to determine whether approval/denial should be granted to Ronald Pauley and Chuck Tanner of Bullhead City, Arizona, for a rezoning from existing A-R (Agricultural Residential) zone to R-E (Residential Recreation) zone, occupying the southwest corner of Harquahala Drive and Aguila Drive in the South Mohave Valley area, and WHEREAS, Section 25 is located eight (8) miles south of Bullhead City'S southernmost limit and one (1) mile east of Highway 95. The section is bounded by Mountain View Road, King Street, Vanderslice Road and Willow Drive. The subject property is accessed from Highway 95 east via King Street to Mountain View Road thence south one-half (.5) mile to Aguila Drive thence east approximately one-quarter (.25) mile to the southwest corner of Aguila Drive and Harquahala Drive, and .. . 'GE BK 2 OF 1992 PG 3 ~32 (FEE;92- 1079) Resolution No. 92-7 Page 2 WHEREAS, review of floodplain map #040058-2610C indicates this area to be within a designated floodplain. The site is currently occupied by residences on two of the three lots. The original site was five (5) acres and was split into three 1.6+ acre sites via parcel plat in February, 1990 to allow for additional residences. The applicant has indicated he desires to pursue this zoning request in order to allow for an additional residence on one of the lots to place a noncommercial guest house. Commission staff indicated to the applicant concerns regarding this request and the applicant felt his request was viable and desired to place this item before the Commission for consideration, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1991, the applicant indicated the reason he is seeking an R-E designation is to establish an additional residence for his mother on his lot under the noncommercial guest house provision of the R-E zoning classification. The Commission did generate a recommendation of DENIAL of this rezone petition from A-R to R-E based on the following: 1. A guest house the same lot guests on an leas ing . Commission Staff has reservations about allowing noncommercial guest houses where there is sufficient land to allow for additions to existing structures rather than allowing for new structures. 4. The is no R-E zoning in the immediate area. 5. Nearest R-E zoning is R-E/ lOA, 1.5 miles to the east, which was designated some time ago and functions as a holding zone for future development. 6. The South Mohave Valley Area Plan does not make provision for this land use/zoning at this location. 7. R-E zoning allows for various uses many of which are not compatible with single family residential uses. 8. The modification of the area plan and subsequent rezone would in essence be spot zoning. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on December 22, 1991, and in the Mohave Valley News, and posted December 20, 1991 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1992 DENIED this change in zoning as recol~lended by the Mohave County Planning and Zoning Conuuission and outlined herein.
