A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO
ALLOW A WATCHMAN'S RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE,
LOCATED ON THE W~ SW~ SE~ SE~ SECTION 17, TOWNSHIP 39 NORTH,
RANGE 16 WEST, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held January 6, 1992 a public hearing was
conducted to determine whether approval should be granted to Bill
Evans of Littlefield, Arizona for a Zoning Use Permit (ZUP) to
establish a watchman's residence, in the basement of the store,
in a C-2 (General Commercial) zone, located on Elbow Canyon Road
one-half (.5) mile east Qf the Nevada State line, in the proposed
"Scenic" area of the Arizona Strip area, and
WHEREAS, Section 17 is located on Arizona's western border
with Nevada and lies south of the Virgin River.
It also lies
within the area proposed to be named Scenic, Arizona. The subject
property is located approximately two and one-half (2.5) miles
southeast of Mesquite, Nevada and approximately one-half (.5)
mile east of the Arizona/Nevada state line.
Access to this
property is provided via Elbow Canyon Road. This road begins on
the east side of the Virgin River at the Bunkerville Bridge in
Clark County, Nevada, extending easterly approximately three and
one-half (3.5) miles intersecting the Arizona state line in

Township 39 North, Range 16 West, G&SRB&M. The subject property
is approximately one-half (.5) mile further east, and
WHEREAS, this site was rezoned C-2 in June 1990, via
Resolution 90-131 and a parcel plat was recorded as a conditional
requirement of this rezone, thus establishing the zoning.
This
parcel is currently vacant however the applicant proposes to
establish a store, bar, and laundromat on the premises. A
building permit application is currently being processed for this
site.
The applicant desires to establish a watchman's quarters
(in the b2.lsement of the store) on the property in view of the
sparseness of development in the area to provide security for the
premises, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on December 11, 1991 and did generate a
recommendation of APPROVAL of the requested Zoning Use Permit
contingent upon the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. In addition to compliance with Ordinance
87-1 (Dark Sky Ordinance) .
2. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
3. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the puLlic health, safety, and welfare.

4. That appropriate zoning/building/environmental permits
be obtained.
5. I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification ,in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on December 22, 1991, and in The Daily
Spectrum and Desert Echo, and posted December 20, 1991 as
required by the Arizona Revised Statutes and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 6, 1992 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
