PAGE 1 OF 4 HOHAVE COUHTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 92-76 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR CONDITIONAL REZONING APPROVAL FOR E~ NW~ AND THE NE~ SW~ PARCEL 69, SECTION 17 , TOWNSHIP 21 NORTH, RANGE 18 WEST, BOARD OF SUPERVISORS RESOLUTION 91-74, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 9, 1992, a public hearing was conducted to determine whether approval should be granted to Thomas Day Kingman, Arizona, for an extension of time for conditional rezoning approval for E~ NW~ and the NE~ SW~ Parcel 69, Section 17, Township 21 North, Range 18 West, Board of Supervisors Resolution 91-74, located in the Golden Valley area, and WHEREAS, subject property is accessed from Highway 68, via Verde road south approximately one-half (~) mile to Shipp Drive then west approximately eight hundred (800') feet on the south side of the road. This parcel is bounded on three sides by the Rancho Verde, Tract 3011, and WHEREAS the Board approved BOS Resolution 91-74 at their regular meeting of March 4, 1991, for the original rezoning action, and . . """"'- Resolution No. 92-76 Page 2 WHEREAS the owner, Mr. Day, is exercising his right to request and extension of time under condition 10 of Resolution 91-74, in accordance with Arizona Revised Statutes annotated Title 11, Chapter 6 (11-832), and WHEREAS the applicant believes that Shipp Drive is a fee parcel owned by Mohave County, and WHEREAS the owner has requested that the proposed dedicated road, formally approved as a forty (40') foot dedicated road, be a thirty (30') ingress/egress easement with an eight (8') foot PUE lying between this easement and the fence. The Commission has no problem with the ingress/egress, but recommends that it also be a PUE to facilitate services crossing it, and WHEREAS a turn around is not essential if the easement is to be used. The owner is requesting deletion of the VNAE requirement. The Commission considered this and recommends a one (1') foot VNAE would help protect contiguous properties and should be retained along the east boundary of the property. The Commission further recommends that it can be included in the PUE with no fence or wall required, and WHEREAS the County Attorney's of f ice, the Assessor's maps and the Planning and Zoning staff concur that no fee title was . ---- pi 30F BK 2019 PG 4 38 (FEE~92-12677) Resolution No. 92-76 Page 3 transferred in 1966. The original Resolution 91-74 requesting abandonment of the fifty (50') foot ingress/egress & PUE easement and dedication of a forty-two (42') foot ROW retaining the south eight (8') as a PUE should be followed, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 12, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. Extension of time to March 4, 1993, and that Resolution 91-74 remain as approved with the exception that the access be a thirty (30') ingress/egress and PUE with an eight (8') foot PUE lying east of it. No curve radius required at Shipp Drive and easement. Provisions will not be required for a turn around at the terminus of this access in accordance with and meeting the standard set forth in the Mohave County Regulations. At the request of Roger Esquerra, cartographer, Commission recommends Final Plat and Parcel plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 23, 1992, and posted February 21, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. .. , .. . PA' .4 OF BK 2019 PG .4 39 (FEE~92-12677) Resolution No. 92-76 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 9, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
