PAGE 1 OF 4 NOH AVE COUNTY BOARD OF SUPERVISORS r3 RECORDING FEE 0.00 He I. _ RESOLUTION NO. 92-72 A RESOLUTION SETTING FORTH THE REZONING OF W~ LOT 44, SUNWEST ACRES, TRACT 1027 LOCATED IN SECTION 19, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/3A AND A-R/4A (AGRICULTURAL- RESIDENTIAL/THREE ACRE AND FOUR ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 9, 1992, a public hearing was conducted to determine whether approval should be granted to Al Haley, President of Specialty Sales, Inc. of Kingman, Arizona, for change from existing A-R/10A (Agricultural a zone Residential/Ten Acre Minimum Lot Size) zone to A-R/3A and A-R/4A (Agricultural-Residential/Three Acre and Four Acre Minimum Lot Size) zones, located on Ligurta Road 1,047 feet south of Redwall drive, located in the Golden Valley Area, and WHEREAS, Section 19 is approximately 1.75 miles south of Highway 68 and approximately 6 miles west of the Highway 68 and 93 junction. The subject property is accessed from Highway 68 via Colorado Road south approximately 1.75 miles Redwall Drive thence west approximately .5 miles to Ligurta Road thence south approximately 1,050 feet to the northwest corner of the subject property, and ~ . . PAGE 2 OF BK 2019 PG 4 26 (FEE~92-1267~) Page 2 Resolution No. 92-72 WHEREAS, Review of the floodplain map #040058-22325 indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land. There are three existing homes on this block. The applicant desires to split this 10+ acre parcel into two 3+ and one 4+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 12, 1992, the Commission recommended the following amended conditional APPROVAL of the requested rezoning and resultant lot split with the applicant understanding and accepting the following conditions: 1. The three parcels be zoned A-R/3A (Agricultural- Residential/Three Acre Minimum Lot Size). The parcel does not have sufficient acreage to fulfill the area needed for the original request. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. Both parcels shall meet or exceed three (3) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage and the FEMA flood zones. . . The Board of Supervisors accept the GRANTING of an eight (8') foot Public Utility Easement contiguous to the western boundary of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the granting statement and granting be shown on the Parcel Plat. 8. No building/zoning permits shall be issued until after Parcel Plat recordation. 9. That appropriate zoning, building and environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being April 8, 1992, as per ARS 11-829E. 11. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roger Esquerra, cartographer, Commission recommends Final plat and Parcel Plat boundaries be a tri Ie wide line as the 1 8~ blue line border obscures dimensions., and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 23, 1992, and posted February 21, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. - .~-;. . . PAGE 4 OF 4 BK 2019 PG 28 (FEE~92-1267~) Page 4 Resolution No. 92-72 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 9, 1992 APPROVED this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
