PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-71 A RESOLUTION SETTING FORTH THE REZONING OF NORTHERN PORTION OF PARCEL 100 RECORD OF SURVEY, SECTION 15, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/5A (AGRICULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 9, 1992, a public hearing was conducted to determine whether approval should be granted to Donald Aldridge, 0 f phoenix, Arizona, for a zone change from existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) zone, occupying the southwest corner of Collins Drive and Aztec road, located in the Golden Valley area, and WHEREAS, Section 15 is approximately .5 miles South of Highway 68 and approximately 4 miles west of the Highway 68 and 93 junction. The subject property is accessed from highway 68 via Aztec Road South approximately 1.5 miles to the south west corner of Collins Drive and Aztec Road, and WHEREAS, Review of the floodplain map #040058-2325B indicates this parcel to be clear of a designated floodplain. The applicant desires to split this 20+ acre parcel into three 5+ acre parcels. This property is located within the Valley Pioneer Water Co. district and the Building Code area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Cornnlission on February 12, 1992, the Commission recommended conditional APPROVAL of the requested rezoning and resultant lot split with the applicant understanding and accepting the following conditions: 1. The three parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The three parcels shall meet or exceed five (5) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. The Board of Supervisors accept the abandonment of the existing thirty (30') foot roadway easements along the north and west boundaries of this parcel to be replaced by the dedication of a thirty (30') foot right-of-way along the north and west boundaries of this parcel (per Public Works request). In addition the twenty (20') foot radius curves at the northeastern and northwestern corners of this parcel. Also the granting of an eight (8') foot PUE along the north boundary of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. -.- '... 2- .., .. . . That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being April 8, 1992, as per ARS 11-829E. 11. I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roger Esquerra, cartographer, Commission recommends Final plat and Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 23, 1992, and posted February 21, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. PAGE 4 OF 4 BK 2019 PG 24 (FEE~92-12673) Resolution No. 92-71 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 9, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
