PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Me i:.:;;':;ufllMID RESOLUTION NO. 92-69 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A WATER BOTTLING FACILITY IN AN A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE ON A PORTION OF PARCEL 5, FORT ROCK RANCHES UNIT IB, SECTIONS 7 & 8, TOWNSHIP 20 NORTH, RANGE 11 WEST, LOCATED IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held March 9, 1992 a public hearing was conducted to determine whether approval should be granted to Aquarius Water Company of Lake Havasu City, Arizona, for a Zoning Use Permit (ZUP) for the establishment of a water bottling facility in a A- R/36A (Agricultural Residential/Thirty-six Acre Minimum Lot Size) zone on a portion of ParcelS, Fort Rock Ranches Unit IB, Sections 7 & 8, Township 20 North, Range 11 West, in the Mohave County General area, and WHEREAS, Sections 7 & 8 are located approximately thirty (30) miles east of Kingman and approximately three ( 3) miles south of 1-40. Access from I-40 is via the Knight Creek Interchange thence south along a number of unnamed county roads to the subject property, and WHEREAS, review of floodplain map #040058-2425B indicates this area to be clear of designated flood zones. PAGE 2 OF 4 BK 2019 PG 1~ (FEE~92-12671) Page 2 Resolution 92-69 land uses consist of mostly vacant land with some homes interspersed in a very low density pattern, mainly ranch houses for the agricultural and ranching concerns in the area, and WHEREAS, the applicant desires to establish a water bottling facility on a newly created 40+ acre parcel. The facility will consist of a "clean room" in which the water will be bottled then shipped to Kingman area for further processing and shipping. The applicant has indicated that the water must be bottled on site and cannot be shipped in large containers to another facility. This condition is part of the requirements of the "Fair Packaging and Labeling Act" and is part of the water bottling regulations administered by the Food and Drug Administration (FDA), and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on February 12, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. NOTE: THE FOLLOWING REQUIREMENTS. 4 ITEMS APPLY TO ENVIRONMENTAL 2 . That sanitary facilities be provided Department of Environmental Quality Health Department requirements. as per and/or Arizona County 3. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 5. Arizona Department of Environmental Quality and/or County Environmental Health Division approves the use and design of the bottling facility(s). NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 6. That pertinent building/zoning/environmental health permits be obtained. 7. That plans for the clean room are submitted to County Environmental Health Division for approval. 8. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 9. That portion of the lot within a three hundred (300') foot radius of the facility shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. ~ ] 10. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 11. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 12. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extens ion r determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ... . OF BK 2019 PG 4 16 (FEE~92-12671) Resolution 92-69 Page 4 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 23, 1992, and posted February 21, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 9, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
