PAGE i OF 5 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-68 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A RECREATIONAL VEHICLE (R-V) AND MOBILE HOME PARK IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE ON A PORTION OF THE N~ SE~ SECTION 34, TOWNSHIP 21 NORTH, RANGE 17 WEST, LOCATED IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held March 9, 1992 a public hearing was conducted to determine whether approval should be granted to Victor and Deloris Mack of Kingman, Arizona, for a zoning Use Permit (ZUP) for the establishment of a recreational vehicle (R-V) and mobile home park in an A-R (Agricultural Residential) zone on a portion of the N~ SE~ Section 34, Township 21 North, Range 17 West, in the Mohave County General area, and WHEREAS, this property is located adjacent to and has access from the I-40 frontage road (Old Highway 66), one (1) mile north of McConnico and Oatman Road Exit. There are existing homes t apartments, factory buildings and businesses along this frontage road. There are two (2) existing homes, one (1) mobile home and one (1) home under construction on this property. The frontage road terminates at the eastern edge of the subject property, and . . Resolution No. 92-68 Page 2 PAGE 2 OF 5 BY. 2059 PG 151 (FEEt92-29476) WHEREAS, site investigation and floodplain map 040058-2325B indicates a large portion of the property to be in a floodplain (Zone A & C). Most of the area proposed for development is above Zone A floodplain, except for the R-V area, which is adjacent to the Holy Moses Wash, and WHEREAS, the property owner is requesting a zoning use permit for a recreational vehicle and mobile home park. Sewage will be handled by septic systems. Water will be provided by private wells. Electricity will be provided by Citizens Utilities Electric Division. The size of this property is approximately six (6) acres, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on February 12, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27 P. (SitePlan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant submit plans and reports in accordance with Section 27-I. and J. of the Mohave County Regulations, or its successor, for review and approval by the Commission and Board of Supervisors. 3. These lots/spaces will not be for sale unless or until they have been approved as subdivided parcels by Mohave County Planning and Zoning and have met all requirements of the State of Arizona. ~ .~ - '. i,~ '} . . PAGE 3 OF 5 BY. 2059 PG 152 (FEE~92-29476) Resolution No. 92-68 Page 3 NOTE: THE FOLLOWING 3 ITEMS APPLY TO ENVIRONMENTAL REQUIREMENTS. 4. Water approval as per Mohave County zoning Regulations Section 27-J. 5. Arizona Department of Environmental Quality approves the quantity and quality of the water supply as water is provided by private wells. 6. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. NOTE: THE FOLLOWING 5 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 7 . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance 8. A one (1') foot vehicle non-access easement (VNE) shall be established along the south boundary of this parcel contiguous to the frontage road except approved access points. This VNE shall be granted by separate instrument and shall be approved by the County Engineer. A staff approved physical barrier will be provided to assure lot protection and non-access. 9. The applicant shall pave all driveway access, roadways, pads and parking in accordance with Mohave County Standard Specification #171, or better. 10. The County Engineer recommends with concurrence of the applicant that Old Cook Road through this property and serving adjacent properties, be a forty (40') foot private roadway, with a thirty (30') foot building setback which applies to the southwest side of the roadway, taking into consideration existing structures and walls. 11. The County Engineer will review the drainage plan along with the site plan submittal. The area of special flood hazard, flood elevations and factors are not determined at this time. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 12. The applicants reserve the right to request expansion on adjacent properties at a future date. The appropriate zoning/building/environmental permits be obtained. 14. Appropriate signage permits be obtained. 15. If construction or use has not commenced within one (1) year of Board approval of the zoning Use Permit, or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 16. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare . 17 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 23, 1992, and posted February 21, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. . ~.~~: .... . . PAGE 5 OF 5 BK 2059 PG 15+ (FEE~92-29+76) Resolution No. 92-68 Page 5 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 9, 1992 postponed final action on this Zoning Use Permit request to their Special meeting of March 23, 1992, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their Special meeting on Monday, March 23, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
