RESOLUTION NO. 92-63-AMENDED
A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION
PLAN AND PETITION OF EXCEPTION FOR THE COVES AT RIVER TERRACE,
TRACT 4139, BEING A PORTION OF SECTIONS 22 AND 23, TOWNSHIP 17
NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA,
MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on March 9, 1992, a public hearing was
conducted
to
determine
the
approval
of
the preliminary
subdivision plan and petition of exception for THE COVES AT RIVER
TERRACE, Tract 4139, and
WHEREAS, a portion of this land is currently owned by the
State of Arizona and is under lease to Frank Curcio of Mohave
Valley, Arizona, who intends to purchase the land prior to
recordation of the Final Plat. The engineer responsible for plan
preparation and drainage study is Gilbertson Associates, Inc. of
Scottsdale, Arizona, and
WHEREAS, the project site is approximately twenty (20) miles
south of Bullhead City on State Highway 95, and continuing to
Higgen's Corner then south one (1) mile on Barrackrnan Road,
entering the subdivision on Riverfront Parkway. The project site
is 186.38 acres in size, with 104.09 acres being under a fee

simple title and 82.29 acres being held under State of Arizona.
The developer proposes development of 586 lots for single family
residential use at a density of 3.15 dwelling units per acre, and
WHEREAS, water and sewage disposal services will be supplied
by Fort Mojave Tribal Utility Authority.
Electric service will
be supplied by Mohave Electric CO-OP, and telephone, by Citizens
Utilities Company.
Solid waste will be removed to the Mohave
County landfill by a private carrier.
Fire protection provided
by Mohave Valley Fire District, and
WHEREAS, the Commission at their meeting on February 12,
1992 did recommend CONDITIONAL APPROVAL of the preliminary
subdivision plan and petition of exception for Tract 4139, with
the following noted:
A petition of exception request is submitted as follows:
A. Lots 1 thru 6 and Lots 56 thru 83 are double fronting
lots on Riverfront Parkway and Living Water Way.
B. Lots 1 thru 12, Blk. 1 are double fronting lots both on
Marina Villa Drive and Levee Road.
C. Lots that exceed the depth to width ration of 3 to 1.
D. 10' utility easements provided along the fronts of the
lots.
E. Streets less than standard widths.
F. Non-radial or perpendicular side lot lines.
The special circumstances or conditions which warrant these
deviations from the design standards are as follows:

a. The granting of this petition will not be detrimental
to the public welfare or injurious to other adjacent
properties. The proposed streets will serve no one
other than the residents and guests of the proposed
subdivision. Further, utility easements ten (10') feet
in width are proposed on either side of the street
right-of-way so that the residents will be provided
wi th the same services as though the streets met the
requirements.
b. This request will not nullify the intent or purpose of
the Master Plan of the County of other regulations
because it is an isolated subdivision with no possible
through traffic, and there are no planned thoroughfares
for the subject area.
c. Utility easements are proposed for the fronts of the
lots adjacent to the private streets. The proposed
purpose of these easements is to provide easements for
the placement of water service meters and other public
utilities outside of private streets. Further 1 the
easements are required for drainage. Lots 1 thru 6 and
56 thru 83 will retain public easements in rear 20 feet
of lots.
d. The special circumstances or conditions effecting said
property are that the proposed project is to be
controlled by a property owners' association. The
subject streets will be owned and maintained by the
association and not by the County. It is desired that
the streets remain private so that parking and
maintenance can be controlled by The Association.
The Commission recommended APPROVAL of the Petition of Exceptions
based on the aforementioned justifications~
2. The conditional approval of this subdivision is based
on the understanding of the Planning and Zoning
Commission that all streets within the subdivision will
be construct9d and paved with asphaltic concrete in
accordance with Standard Specifications # 171 and
#101.10D or better; the streets shall include curb and
gutter they shall be privately owned; a water supply
and distribution system including fire flow will be
constructed to serve each lot; grading and drainage
related improvements will be completed as recommended
by the design engineer and as approved by the County
Engineer in the submitted and approved drainage
reports; arrangements will be made to extend
underground electric and telephone service to each lot

in accordance with Arizona Corporation Commission
regulations; approval for water system and sewage
disposal shall be obtained from the Arizona Department
of Environmental Quality prior to recording the Final
Plat, the FMTUA agreement for sewer services shall be
filed with the P&ZC staff; water availability statement
to be obtained from the FMTUA; all lots and street
centerline monuments will be staked and monumented in
accordance with Standard Specification #102; fire
hydrants will be provided at locations prescribed by
the Mohave Valley Fire District; street name and
regulatory signs will be installed in accordance with
the requirements of the Mohave County Subdivision
Regulations and as recommended by the design engineer
and; the owner/subdivider is responsible for the
completion of improvements and shall provide assurance
for all required subdivision improvements in accordance
with Article V of the Subdivision Regulations.
3. The developer will make the same commitments for
improvements in the prospectus to the State Real Estate
Commission as required for approval of this tract by
the Board and a final copy of the State Real Estate
Report shall be submitted to P&Z staff. This copy
shall be for library purposes.
4. A corporate entity for this project shall be formed or
annexed by an existing entity for this project's block
walls, drainage easements, streets, or any other
facilities deemed private in nature. A recorded copy
of the Articles of Incorporation shall be submitted
with the Final Plat.
5. The County Engineer has made comments in regard to the
revised final drainage report and the preliminary plan
as submitted, in a letter dated January 29, 1992.
Staff is confident that all concerns will be addressed
and resolved to the County Engineer's satisfaction
prior to submission of this subdivision to the Board of
Supervisors for Final plat actions.
6. Approval from The Mohave Valley Irrigation & Drainage
District on the water allocation for this project.
7. ADEQ certificate of approval for water and sewage
disposal systems.
8. That Parcel J-J be omitted from this tract's boundary,
unless a solution acceptable to all parties is reached.

At the request of Roger Esquerra, cartographer, Commission
recommends Final Plat and Parcel Plat boundaries be a triple wide
line as the 1/8" blue line border obscures dimensions.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, March 9, 1992, conditionally
approved this preliminary subdivision plan and petition of
exception as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of
Supervisors at their regular meeting on Monday, April 6, 1992 did
approve this amended resolution.
