RESOLUTION NO. 92-54 EVALUATION OF A FINAL SUBDIVISION PLAN OF SUN DESERT, TRACT 4121, BEING A SUBDIVISION OF A PORTION OF THE NE~ SW~ OF SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on February 18, 1992, a public hearing was conducted to determine the approval of the final subdivision f~'] I ': I I L~':; plan, for SUN DESERT, Tract 4121, located in the South Mohave valley area, and WHEREAS, the owner/subdivider of this tract is Phil Jost, Bullhead City, Arizona. The engineer of record on this project is Chuck Dewald of Territorial Engineers, Incorporated of Bullhead City, Arizona, and WHEREAS, this property is located approximately two and one- half (2.5) miles south of Bullhead City's southern most boundary and is approximately one and one-quarter (1.25) miles east of Highway 95. Moreover, this project is accessible via Highway 95, south to Joy Lane, then east upproximately one (1) mile to the intersection of Joy Lane and Mountain View Road, then north approximately one-half ( . 5 ) mile to Van Mouwerik, then . P. 20F BK2010 PG 5 25 (FEEt92- 8760) Resolution No. 92-54 Page 2 approximately three hundred thirty (330') feet to Sun Desert Estates, Tract 4121, and WHEREAS, the approved preliminary subdivision plan depicts approximately fifteen (15) acres subdivided into forty nine (49) individual lots. The proposed minimum lot size for this project will be 8,800 square feet with a maximum lot size being proposed as 13,420 square feet. This property is bordered on the north by the proposed Moon Ridge subdivision, on the south by the proposed Pine River Estates and Moon Valley subdivisions, on the west by Tierra Del Rio, Tract 4048-D, and on the east by unsubdivided f:::1 , properties and a portion of Moon Ridge. These projects are , l.,..,j located on the western alluvial slope of the Black Mountains and are subject to flash flooding and sheet flow runoff. The Pine River Estates subdivision, Sun Desert Estates subdivision and the Moon Valley Tract, have been consolidated into one ( 1 ) comprehensive drainage study, and WHEREAS, the developer intends the domestic water supply to be provided by the Bermuda Water Company. Sewage disposal is proposed to be by individual septic systems. Power will be provided by the Mohave Electric Cooperative Inc. and telephone will be provided by Citizens Utilities. The developer also intends to provide natural gas to this project approximately one hundred twenty (120) days after final plat approval. The natural gas provider will be Southwest Gas, and . PA' 3 OF BK 2010 PG 5 26 (FEE~92- 8760) Resolution No. 92-54 Page 3 WHEREAS, the approval of this subdivision is based on the understanding of the Board of Supervisors that all streets within the subdivision shall be constructed and paved with asphaltic concrete in accordance with Standard Specifications #171 and 101.10A or better; the streets shall include curb and gutter; use of inverted crowns is accepted, and the owner/subdivider shall install a water distribution system to serve each lot within the subdivision; fire hydrants shall be provided in accordance with the requirements of the Fort Mohave Mesa Fire Department; sewage disposal is to be handled by individual septic systems; grading and drainage related improvements will be made as recommended by f--':l l J " .1 :;^.J the project engineer in the drainage report; arrangements will be made to extend underground electric, telephone and water service to each lot in accordance with Arizona Corporation Commission Regulations; final approval for the completed water system and the sewage disposal system shall be obtained from the Arizona Department of Environmental Quality; water availability statement to be obtained from the Arizona Department of Water Resources; all lots and street centerline monuments will be staked and monumented in accordance with Mohave County Standard Specification No. 102; street name and regulation signs will be installed in accordance with Mohave County Subdivision Regulations; and as a condition of approval the owner/subdivider is responsible for the completj.on of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations, and CJ ;., ~,.:.;J~I I I ~ ! . P' 4- OF BK 2010 PG 5 27 (FEE~92- 8160) Resolution No. 92-54 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board APPROVES the said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the Subdivision Questionnaire to the Real Estate Commission as required for approval of this tract by the Board. A copy of the draft and final report delivered to the Arizona State Real Estate Department shall be submitted to the county; 2. Arizona Department of the water and sewer subdivision; Environmental Quality approves system installation for this 3. The owner/subdivider shall cause the engineering drainage related improvements to be completed recommended by the project engineer and outlined in detailed drainage report as approved by staff; and as the 4. The Final Plat for Tract 4121, including the dedications, shall be properly executed and/or sanctioned by all parties having any recorded ti tIe interest in the land being subdivided and included on this subdivision; 5. An approved method of assurance and/or surety shall be provided in the amount of the approved cost estimate for all required site improvements; 6. The original signed copy of the CC&R's shall be submitted prior to final recordation; 7. A new Title Report shall be submitted prior to recordation; 8. Compliance with Board of Supervisors Resolution 91-96, which approved this subdivision's zoning, shall be required. Moreover, the zoning approved by Board Resolution 91-96, shall become effective upon recordation of this tract; 9. A complete set of As-builts for this project shall be submitted prior to this tract being recorded; 10. A fifteen (15 ') foot building setback line along Van Mouwerik shall be established from the side property line; " . . PAGE 5 OF BK 2010 PG 5 28 CFEEt92- 8760) Page 5 ~' Resolution No. 92-54 11. Van Mouwerik Drive shall be dedicated as a sixty (60') foot right-of-way and a five (5') foot roadway easement/PUE I s with an eight (8') foot PUE on either side for a total of thirteen (13') feet. The abandonment of the thirty (30') foot I&E/PUE shall be accomplished prior to recordation of the final plat. This dedication does include the required adjacent east 1/2 R/W for Van Mouwerik Drive; 12. Recordation shall be held if provisions are not made to insure the access road into this development will be improved in the event developments to the north are not in place when this tract is recorded. NOW THEREFORE BE IT FURTHER RESOLVED, corrected copies of all documents delineated above shall be submitted for staff review and upon receipt of the evidence that these conditions !".-:] have been met, together with the executed mylars and appropriate l.....J recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County Departments and officials and cause the final plat to be recorded. NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing has been met and published throughout this subdivision process and the public was afforded notice of this final action through advertisement of the Board of Supervisors' meeting for this date.
