PAGE 1 Of 3 MOHAV( COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He 5' RESOLUTION NO. 92-39 A RESOLUTION SETTING FORTH CONDITIONAL APPROVAL OF A REQUEST OF ABANDONMENT OF THE WESTERLY TWENTY (20') FEET OF THE EXISTING FIF'l'Y (50') FOOT ROAD EASEMENT, BEING HASSAYAMPA ROAD, ON A PORTION OF THE EAST BOUNDARY OF PARCEL 322, SECTION 20, TOWNSHIP 21 NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held February 3, 1992 a public hearing was conducted to determine whether approval should be granted to M. Louise Bradley of Kingman, Arizona, for the abandonment of the westerly twenty (20') feet of the existing fifty (50') foot road easement, being Hassayampa Road, on the east boundary the SE~ NE~ of Parcel 322, Section 20, Township 21 North, Range 18 West, in the Golden Valley area, and WHEREAS, the subject property is located approximately one and three-quarters (1.75) miles south of Arizona Highway 68 and eight (8) miles west of Kingman city limits. Access to the property is via Arizona Highway 93 approximately two (2) miles northwest of the Kingman city limits to Arizona Highway 68, then approximately six and one-quarter (6.25) miles west to Colorado Road, then south one and three-quarter (1. 75) miles to Newgard Drive, then east one-quarter (.25) mile to the intersection of Newgard Drive and Hassayampa Road. Resolution 92-39 PAGE 2 OF 3 BY- 200~ PG 156 <FEE~92- 6t56) Page 2 feet north from this intersection and is concerned with the abandonment of the fifty (50') foot roadway and utility easement along the eastern boundary of the SE~ NE~ of Parcel 322, and WHEREAS, the applicant is requesting the abandonment in order to better utilize the property adjacent to Hassayampa Road. By the approving of this abandonment, the area of this lot will increase, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on January 8, 1992 did generate a recommendation of approval of this abandonment with the following conditions noted: 1. In his letter Harold J. Ganyo, County Engineer states, "This department has no objection to the abandonment of 20 feet of the existing 50 foot roadway easement along the west 1/2 of Hassayampa Road provided that the remaining 30 feet of ROW be dedicated to the Public right of way. This area falls wi thin a FEMA zone A (Cerbat Wash)." 2. That the thirty (30) foot right-of-way be dedicated to Mohave County as Roadway. 3. That the granted fifty (50) foot public utility easement (P.U.E.) shall remain, thereby protecting the easement provided to Citizen's Utilities per book 1201 of Official Records, page 899-900. 4. Citizens Utility was contacted and they have no objection to the aforementioned action provided their easement is protected. 5. That the abandonment take place upon recordation of the Parcel plat as required by Board of Supervisors Resolution 88-221. .~ .. . . Resolution 92-39 PAGE 3 OF 3 156) BK 2004 PG 157 (FEE~92- 6 Page 3 6. On the approval by the Board and recording of the plat, the twenty (20) foot strip will accrue to the adjoining parcel. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 19 and 26, 1992, and in the Mohave Valley News, and posted January 17, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3, 1992 approved this abandonment request as recommended by the Mohave County Planning and zoning Commission, subject to the condition outlined herein.
