PAGE 1 OF 3 ~OHAVE COUMTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-37 A RESOLUTION SETTING FORTH THE REZONING OF THE SE~ LOT 13, PARADISE ACRES UNIT #1, SECTION 14, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3, 1992, a public hearing was conducted to determine whether approval should be granted to Steven and Elisabetta Schwartz, for a zone change from existing A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone to A-R/IA (Agricultural Residential/One Acre Minimum Lot Size) zone, occupying the northwest corner of Crystal Drive and Horn Road in the Golden Valley area, and WHEREAS, Section 14 is approximately one-half (.5) mile south of Highway 68 and approximately two (2) miles west of the Highway 68 and 93 junction. The subject property is accessed from highway 68 via Houck Road south approximately three-quarter (.75) mile to Crystal Drive, West approximately 620' to the corner of Crystal Drive and Horn Road, and WHEREAS, review of the floodplain map #040058-2435C indicates this parcel to be clear of a designated floodplain. Resolution PAGE 2 OF 3 BK 2004 PG 151 (FEE~92- 6154) Page 2 The property is currently occupied by a single wide mobile home. Surrounding land uses consist of a mixture of homes and vacant land. The applicant desires to split this 2+ acre parcel into . two 1+ acre parcels. This property is located within the Valley Pioneer Water Co. district and the Building Code area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 1992, the Commission "j ;" recommended conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The two parcels be zoned A-R/1A Residential/One Acre Minimum Lot Size). (Agricultural- ~ :.; 2. Submittal and recordation accordance with Article Subdivision Regulations. of a Parcel Plat prepared in 3.16 of the Mohave County " " ., ~ 3. The establishment of a minimum lot si.ze based on. the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. Both parcels shall meet or exceed one (1) acre exclusive of road easements or rights-of-way. 6. The Board of Supervisors accept the GRANTING of an eight (8') foot Public Utility Easement. contiguous to the southern boundary of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that. the granting statement and granting be shown on the Parcel Plat. Public Works comments are as follows: No objection to this request, provided that the owner be required to grant PUE's as neceSsary to all splits. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 9. That appropriate zoning/building/environmental permits be ob.tained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being March 4, 1992, as per ARS 11-829E. 11. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 19, 1992, and posted January 17, .1992 as required by Arizona Revised Statutes, and the Mohave county Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3, 1992 approved this change in zoning as recommended by the Mohave County Commission and Qutlined herein.
