PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-103 A RESOLUTION SETTING FORTH A REQUEST TO AMEND RESOLUTION P&ZC: 88-30 WHICH APPROVED THE REZONING OF A PORTION OF THE E~ SE~ SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS AZTEC VILLAS, TRACT 4065, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: R-1/8M (SINGLE FAMILY RESIDENTIAL/EIGHT THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1992, a public hearing was conducted to determine whether approval should be granted to Howie Torn, Counsel Corporation, of Lake Elsinore, California, to amend Resolution P&ZC: 88-30 which approved the rezoning of a portion of the E~ SE~ Section 23, Township 19 North, Range 22 West, to be known and subdivided as AZTEC VILLAS, Tract 4065, from the existing A-R (Agricultural Residential) zone to R-1/8M (Single Family Residential/Eight Thousand Square Foot Minimum Lot Size) zone in the South Mohave Valley area, and WHEREAS, Section 23 is located one (1) mile south of Bullhead City's southernmost border and is bounded by Highway 95, Camp Mohave Road, Mountain View Road and EI Rodeo Road. The subject property is accessed from Highway 95 via Aztec Road east approximately one-half (.5) mile on the north side of the road, and - .- . . The site is bounded by Camino Colorado on the north, Calle Del Media on the east and Aztec Road on the south. Surrounding land uses consist of Courtney Greens, Tract 4054-B to the south, Riverside Adventure Trails R-V park to the west, Camino Colorado, Tract 4089 and unsubdivided land to the north and east, and WHEREAS, the preliminary subdivision plan depicts twenty (20) acres divided into sixty-seven (67) lots having a minimum lot size of eight thousand (8,000) square feet and a maximum lot size of seventeen thousand (17,000) square feet for an overall density of 3.4 lots per acre. The tract was originally approved for zoning via Resolution P&ZC: 88-30 which provided for R-1/8M (Single Family Residential/Eight Thousand Square Foot Minimum Lot Size) zoning. Because of a revision to the originally approved plat, four (4) lots do not meet the specifications for a R-1 zoned lot. Therefore the developer is requesting the four (4) lots be zoned R-O which allows lots to be less the one hundred (100') feet in depth. In addition, the redesign created a large parcel designated "A" on the revised plat. That lot will also have to be rezoned to reflect a new minimum lot size to restrict the use of the property to one (1) dwelling unit until such time as a community sewer allows for further density, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on March 11, 1992, the Commission recommended conditional APPROVAL of the requested amendment of '"'" _. . . That Parcel "A", as shown on the revised preliminary plat approved via Resolution 92-66, be zoned R-1/1A (Single Family Residential/One Acre Minimum Lot Size). No redividing of Parcel A will be permitted until community sewer allows for further density. 2. That Block 1, Lots 1, 2, 25 & 26, as shown on the revised preliminary plat approved via Resolution 92-66, be zoned R-O (Single Family Residential Mobile Homes Prohibited) . 3. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Ordinance 87-1 (Dark Sky Ordinance) is also required. 4. Compliance with all conditions of P&ZC Resolution 88-30 EXCEPT Parcel A and Block 1, Lots 1, 2, 25, 26. 5. Compliance with all conditions of Resolution 92-66. 6. The ~ezone shall become effective upon the recordation of the Final Plat. Ii development is phased, then only the zoning for that phase shall become effective. At the request of Roger Esquerra, cartographer, the Planning Commission recommends Final Plat and Parcel Plat boundaries be a tri Ie wide line as the 1 8" blue line border obscures dimensions on prints. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 22, 1992, and in the Mohave Valley Daily News, and posted March 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. -- -=- -." . NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1992 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
