PAGE 1 OF 3 'tt~'~~~;I MOHAVE COUNiY BOARD OF S~PERVISORS ';':'~t;~ ,RECORDIHG FEE O.Ou NC ~3) RESOLUTION NO. 92-99 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE CONDITIONAL REZONING APPROVAL OF LOT 3, BLOCK D, MAIRLYN ACRES, FROM: C-l (NEIGHBORHOOD COMMERCIAL) ZONE, PROPOSED TO BE: C-2H (HIGHWAY COMMERCIAL), APPROVED VIA RESOLUTION 91-12, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1992, a public hearing was conducted to determine whether approval should be granted to Oscar Santa Maria of Ontario, California, for an extension of time for conditional rezoning approval of Lot 3, Block D, Mairlyn Acres, from to C-1 (Neighborhood Commercial) to C-2H (Highway Commercial), approved via Resolution 91-12, located one hundred fifty (150') feet south of Los Gauchos Road east of Highway in the South Mohave Valley area, and WHEREAS, the subject property is located on the east frontage of Highway 95 approximately one hundred fifty (150') feet south of Los Gauchos Road. Review of floodplain map #040058-2445C indicates this area is in a FEMA designated floodplain. This property is currently vacant and surrounding land uses consist of a gas station to the north and vacant land on the south and east. There are residences to the east but there are intervening R-M (Multiple Residential) designated '- . . PAGE 2 OF 3 BK 2032 PG 122 (FEE~92-18002) Resolution No. 92-99 Page 2 parcels. The applicant has identified a car sales business on this property. The South Mohave Area plan allows for this commercial land use, and WHEREAS, the Planning Commission conditionally approved this item at their December, 1990 meeting and the Board of Supervisors approved the rezone via Resolution 91-12. The applicant has indicated a potential buyer for the property fell through and he has not been able to meet the conditions of the Board approval, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. This extension shall be for one (1) year only, to January 7, 1993. 3. Compliance with all conditions of Resolution 91-12. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 22, 1992, and in the Mohave . . PA~ 3 OF 3 BK 2032 PG 123 (FEE~92-18002) Resolution No. 92-99 Page 3 Valley Daily News, and posted March 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1992 approved this extension of time for a conditional rezoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
