RESOLUTION NO. 92-98
A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR AN
OFF PREMISE SIGN IN A C-2 (GENERAL COMMERCIAL) ZONE LOCATED IN
THE N~ NE~ SE~ SECTION 3, TOWNSHIP 18 NORTH, RANGE 22 WEST,
LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held April 6, 1992 a public hearing was conducted
to determine whether approval should be granted to BULLCONE 80, a
California General Partnership in Encino, California, for a
Zoning Use Permit (ZUP) for an off premise sign in a C-2 (General
Commercial) zone located in the N~ NE~ SE~ Section 3, Township 18
North, Range 22 West, located west of Highway 95 between Lipan
Boulevard and Boundary Cone Road in the South Mohave Valley area,
and
WHEREAS, Section 3 is located four (4) miles south of
Bullhead City's southernmost border and is bounded by Highway 95,
extensions of Boundary Cone Road and Lipan Boulevard and Fort
Mojave Indian Reservation (FMIR) land. The proposed site of the
off-premise sign fronts on Highway 95, and
WHEREAS, review of floodplain map #040058-2445C indicates a
portion of the site may be in a designated minor floodplain. The
site is currently vacant.
Surrounding land uses consist of

vacant land with the east half being zoned C-2 (General
Commercial) and the west half being zoned A-R (Agricultural-
Residential) except the northeastern forty (40) acres which is
zoned M (General Manufacturing), and
WHEREAS, there are currently no off premise signs on this
side of the Highway.
There are some signs on the east side of
the Highway which is FMIR land.
Under current regulations only
four (4) off-premise signs are allowed per linear mile between
section line roads.
Because the neighboring section is FMIR and
not under County jurisdiction some questions arise as to the
placement of signs on private land.
The Commission staff
contacted Arizona Department of Transportation (ADOT) who also
has restrictions on the number and placement of off premise signs
along State Highways.
ADOT has indicated that they do not take
into
consideration
signs
located
in
Fort
Mojave
Indian
Reservation lands, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on March 11, 1992 and did generate a
recommendation of APPROVAL of the requested zoning Use Permit
contingent upon the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
2. That appropriate zoning/building/environmental permits
be obtained.
3. That ADOT permits be obtained.

4. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
5. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
6. I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on March 22, 1992, and in The Daily
Spectrum and Desert Echo, and posted March 20, 1992 as required
by the Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, April 6, 1992 approved this
Zoning Use Permit as recommended by the Mohave County Planning
subject to the conditions outlined herein.
