I() '1 . ~OJ RESOLUTION NO. 92-95 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A RETAIL PLANT NURSERY IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE, ON A PORTION OF THE NW~ & SW~ SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, LOCATED IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held April 6, 1992 a public hearing was conducted to determine whether approval should be granted to Rusty Wilson of St. George, Utah, for a, Zoning Use Permit (ZUP) for the r-'~ !' establishment of a retail plant nursery in an A-R (Agricultural i lq Residential) zone on a portion of the NW~ & SW~ Section 3, Township 40 North, Range 15 West, located south of Interstate 15 and east of the agricultural equipment underpass in the Arizona Strip area, and WHEREAS, this application is submitted by Rusty Wilson as owner. This seven (7) acre parcel is part of a ten (10) acre parcel that abuts the County frontage road which is contiguous to and parallel with the Interstate 15 right-of-way. The property frontage is approximately five hundred fifty (550') feet. Resolution No. 92-95 /~ - Page 2 PAGE 2 OF 3 BK 2032 PG 10"" (FEE~92-17998) WHEREAS, considerable activity is occurring in this area, with two (2) proposed subdivisions, several houses and mobile homes, a new fire station and an auto salvage yard to the west along the frontage road, and WHEREAS, this proposal is a compatible use in the growing residential communities of Littlefield, Beaver Dam and Desert Springs, and PAGE 2 OF 3 BK 2053 PG 245 (FEEt92-26931) WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on March 11, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit r~: contingent upon the following conditions: i i i l,~_~~ 2. This parcel is included as a second parcel of the parcel plat required in I--e.em--#:-J.-.Q.i--1;l:l..i.s--ag.enda- RESOLUTION NO. 92-94. The zoning Use Permit to not be in effect until the parcel plat is recorded. 3. The appropriate zoning/building/environmental permits be obtained. 1. 4. Appropriate signage permits be obtained. 5. The applicant comply with all applicable provisions of Sections 25, 26, 27 and 31 of the Mohave County zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 6. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 7. I l' these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property 'to, revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated Title 11, Chapter 6, 11-832, WHER&~, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 22, 1992, and in The Daily Spectrum and Desert E:cho, and posted March 20, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. PAGE 3 OF 3 BK 2053 PG 246 (FEE~92-26931) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meet:ing on Monday, April 6, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
