PAGE 1 OF 4 ~~'~~~~~j MOHAVE COUNTY BOARD OF SUPERVISORS ~Z<.zl~-"",~- RECORDING FEE 0.00 He Jic:mflL\\m ~3J RESOLUTION NO. 92-94 /VI)} ~ () K., A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE ~ 1&- 3-JI-,'Y SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: C-2H/2A (HIGHWAY COMMERCIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board j I I of Supervisors held on April 6, 1992, a public hearing was conducted to determine whether approval should be granted to Rusty Wilson of St. George, Utah, for a zone change from existing A-R (Agricultural Residential) zone to C-2H/2A (Highway Commercial/Two Acre Minimum Lot Size) zone, located south of Interstate 15 and east of the agricultural equipment underpass in i 1 I the Arizona Strip area, and WHEREAS, this application is submitted by Rusty Wilson as owner. This two (2) plus acre parcel is part of a ten (10) acre parcel that abuts the County frontage road which is contiguous to and parallel with Interstate 15. The property frontage is approximately five hundred fifty (550') feet. ',' L.'~'-'--"~."--". , 4 Resolution No, 92-94 PAGE 2 OF 4 BK 2032 PG 100 (FEE~92-17997} Page 2 WHEREAS, considerable activity is occurring in this area with two (2) proposed subdivisions, several houses and mobile homes, a new fire station and auto salvage yard to the west along the frontage road, and WHEREAS, this proposal is a compatible use, in the growing residential community of Littlefield, Beaver Dam and Desert Springs. This, proposed commercial use is proposed in conjunction with a retail plant nursery (Resolution No. 92-95), and WHEREAS, at thE' public hearing before the Mohave County Planning and Zoning Conunission on March 11, 1992, the Commission reconunended a conditional, APPROVAL of the requested rezoning with the understanding the following applicant and accepting conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27 and 31 of the Mohave County Zoning Regulations. Compliance with Se<;:tion 27,P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required, 2. That appropriate zoning/building/environmental permits be obtained, 3, A parcel plat for the division of this ten acre parcel, into two parcels, be submitted as a condition of approval o:E this rezone. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. This paving will not be required until after the frontage road contiguous to this property has been paved. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 7. The rezoning approval for C-2H/2A (Highway Commercial Two Acre Minimum Lot Size) zone shall not be effective before May 6, 1992; as per ARS 11-829E, and until a parcel plat is approved and recorded. 8. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 22, 1992, and in The Daily Spectrum and Desert Echo, and posted March 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. Resolution No. 92-94 PAGE 4 OF 4 BK 2032 PG 102 (FEE~92-17997) Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1992 approved this change in zoning as reco~nended by the Mohave County Planning and Zoning Commission and outlined herein.
