RESOLUTION NO. 92-93
WHEREAS, a petition was filed with the Clerk of the Board of
Supervisors of Mohave County, Arizona, on March 23, 1992, praying
for the establishment of a domestic water improvement district to
be known as the Beaver Dam East Domestic Water Improvement
District of Mohave County, Arizona, under the provisions of
Sections 48-901 through 48-965, and 48-1011 through 48-1018, all
inclusive, Arizona Revised Statutes (the "County Improvement
District Statutes") for the purpose of acquiring an existing
domestic water delivery system; and
WHEREAS, the property owners have filed with the Clerk a
waiver agreement waiving certain rights under the County
Improvement District Statutes and requesting this Board to form
the district; and
WHEREAS, after proceedings to that end duly had and taken
pursuant to Arizona Revised Statute, Title 48, Chapter 6, Article
1, this Board did, on this day, set and conduct a public hearing
on the formation of Beaver Dam East Domestic Water Improvement
District of Mohave County, Arizona; and
WHEREAS, notice of hearing has been waived by the property
owners; and
WHEREAS, no persons wishing to object
of the proposed district have filed their
Clerk of this Board, and none appeared
presented oral objections thereto; and

to this Board and this Board has duly considered the same;
NOW, THEREFORE ,
RECORDED AS FOLLOWS:
IT IS FOUND r DETERMINED, ORDERED AND
1. That the petition presented to this Board as a result of
which it set this hearing was signed by the requisite
number of owners of real property within the proposed
district, and is sufficient.
2. That the public convenience, necessity and welfare will
be promoted by the establishment of the district.
3. That all of the property within the proposed district
will be benefited by being formed into such district and
that said proposed district includes all of the property
that would be benefited by being so formed.
4. That the boundaries of said district are hereby
established as those more particularly set forth in the
Exhibit "A" hereto attached and by reference made a part
hereo f .

5. That said territory is hereby declared formed into a
county domestic water improvement district under the
corporate name of Beaver Dam East Domestic Water
Improvement District of Mohave County, Arizona, by which
name it shall be known in all proceedings. Said
district shall be authorized to make any local
improvements and take all other actions and exercise all
other powers of a county domestic water improvement
district as may now or hereafter be granted under law.
6. The district shall be governed by an elected board of
directors consisting of three (3) members. The initial
directors and the expiration of their terms shall be as
follows:

7. Said district shall hereafter be body corporate with the
powers of a municipal corporation for the purposes of
carrying out the provisions of applicable law.
8. The Waiver Agreement executed by the property owners is
hereby accepted, which acceptance may be evidenced by
the execution thereof by the Clerk.
9. The Clerk shall mail a copy of this order to the
Department of Revenue and to the County Assessor of this
County pursuant to Arizona Revised Statutes Section 42-
483.
10. A copy of this resolution will be recorded in the office
of the Mohave County Recorder.
PASSED, APPROVED AND ADOPTED by the Mohave County Board of
Supervisors this 23rd day of March, 1992.
