PAGE lOF 5 nOHAVE COU~TY BOAh~ OF SUPERVISORS RECORIHMG FEE O.OONC RESOLUTION NO. 92-149 A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF PORTION OF LOTS 10 AND 11, SILVERADO ESTA,TES, SECTION 5, TOWNSHIP 20 NORTH, RANGE 13 WEST, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-2/2A (GENERAL COMMERCIAL/TriO ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to determine whether approval should be granted to James C. and Mattie M. Ferguson of Mesa, Arizona, for a zone change from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to C-2/2A (General Commercial/Two Acre Minimum Lot Size) zone, located on the east side of Highway 93 approximately one (1) mile south of the Interstate 40 in1;erchange in the Mohave County General area, and WHEREAS, Section 5 is located approximately one (1.) mile south of the Highway 93 and Interstate 40 junction east of Kingman (Round Valley Interchange). The subject property had frontage on the west side of Highway 93 one (1) mile south of the interchange, and / <. The site is currently vacant. Surrounding land uses consist of primarily vacant land. The applicant desires to rezone an approximately two plus (2+) acre commercial site and live on the remainder of two (2) platted residential lots. The applicant plans on establishing a fast food restaurant with future plans for a convenience/retail store at a later date, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. NOTE: THE FOLLOWING REQUIREMENTS. 3 ITEMS APPLY TO ENVIRONMENTAL 2. Arizona Department of Water Resources approves the water supply and distribution system. 3 . Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 4. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. r j ~ . . . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 6. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or better. 7. The applicant obtain required ADOT permits for access to Highway 93. NOTE: THE FOLLOWING ITEMS APPLY TO PARCEL PLAT REQUIREMENTS. Public Works suggested a parcel plat be required to show the split of Parcel 10. The Planning Commission concurs as the applicant is separating the uses of the parcel he owns, the north portion being the subject of this approval. 8. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. (,~ "j I" 9. The commercial parcel shall meet or exceed two (2) acres exclusive of road easements or rights-of-way. 10. The establishment of a minimum lot size based on the size of the parcel per the recorded Parcel Plat. 11. The Parcel Plat shall show any surface drainage or FEMA flood zones. 12. The Board of Supervisors accept the DEDICATION of a twenty (20') foot radii at the corner of Highway 93 and Crazy Horse Road. The granting of eight (8') foot PUEs contiguous to the north and east boundary of this property is also required. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statements and dedication/granting be shown on the Parcel Plat. 13. That appropriate zoning/building/environmental permits be obtained. 15. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8 n) inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 16. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being June 3, 1992, as per ARS 11-829E. 17 . I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 19, 1992, and posted April 17, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. ,.
